DEFINITIONS, SECTION 42.K.4.f., AND SECTION 42.K.4.g., OFF- PREMISE SIGNS, TO ALLOW CHANGES TO BE MADE TO THE FREE-STANDING SIGN DEFINITION, AND TO ALLOW FOR OFF-PREMISE SIGNS ON WATER AND FUEL TANKS, AND ALLOW OFF-PREMISE SIGNS IN THE I-40 INDUSTRIAL AREA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 1, 2016,G public hearing was conducted to determine whether approval should be granted for an Amendment to the Mohave County Zoning Ordinance, as requested by Mohave County, and WHEREAS,the Department of Development Services has received requests to allow off- premise signage on water and fuel tanks. Currently off-premise signs are only allowed on free- standing signs as defined by the Mohave County Zoning Ordinance. Allowing off-premise signs on water and fuel tanks would provide additional options in which to place off-premise signs that does not require the plaelment of a free-standing sign structure, and WHF REAS, staff also found while researching the Mohave County Sign Ordinance, that the definiticn for a free-standing sign is not consistent with the Uniform Sign Code. Staff is proposing an amendment to the definition of a free-standing sign in order to be consistent with the Uniform Sign Code, and WHEREAS,the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect comply with the Mohave County General Plan. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 13, 2016, the Commission recommended APPROVAL for this Ordinance, and ORDINANCE NO. 2016-08 PAGE 2 WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on July 17, 2016, and was posted on July 15, 2016, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED,that the Board of Supervisors, at their regular meeting on Monday, August 1, 2016, APPROVED this Ordinance as recommended by the Mohave County Planning and Zoning Commission and outlined as follows. AMEND Section 42.B. Definitions of the Mohave County Zoning Ordinance as follows(wording to be deleted is struck; wording to be added is bolded and double underlined): Freestanding Signs: - - . . . • -- -: -, • - •- - . - . - uprights, mast, or pole, set in a fixed position in the ground and not attached to A si;n principally supported by one or more columns,poles, or braces placed in or upon the ground. May also be referenced as a Ground or Monument Sign. AMEND Section 42.K.4.f. and g., Off-Premise Signs of the Mohave County Zoning Ordinance as follows (wording to be deleted is struck; wording to be added is bolded and double underlined): f. Prohibited areas. Except as provided in these Regulations, all off-premise signs shall be prohibited at any of the following locations: 1) Less than one hundred (100) feet measured from the nearest residential property line located in in any residential zoning district. 2) Designated "Sign Free" areas where gradual and eventual elimination rather than expansion of nonconforming off-premise signs and structures will be undertaken and no new signs will be installed as follows: designated areas on Highway 95 approaching Lake Havasu City, along Interstate 40 in the Yucca area(Sections 12 and 13, Township 17 North, Range 18 West), and in any area designated in the Mohave County General Plan as a Scenic Route or Vista,except Highway 93 north of Pierce Ferry Road, Interstate 40 between the Griffith Interchange and the northern section line of Section 19, Township 20 North, Ranee 17 West, and Interstate 15. These designated areas would not preclude the establishment of noncommercial signage or temporary signs if established by zoning special use permit and approved by the Board of Supervisors. 3) Within five hundred (500) feet at the beginning or end of pavement of the exit or entrance of a traffic interchange. 4) Less than one thousand (1,000) feet from the exterior boundary of any Federal, State, County, or City historic district,park or monument. ORDINANCE NO. 2016-08 PAGE 3 5) Additional areas may be designated by the Board of Supervisors in a similar manner as an amendment to these Regulations. g. Method of installation. Each off-premise sign shall be erected as a freestanding sign Qr placed on a water or fuel tank as defined in these Regulations. No off-premise sign shall be erected on the wall or roof of a building. The name of the maker, the date of erection, and the permit number shall be permanently affixed to each sign installation. Such information shall be clearly- legible and located in a conspicuous place on each sign.
