MOHAVE COUNTY ORDINANCE NO. 2018-03
AN ORDINANCE SETTING FORTH AN AMENDMENT TO MOHAVE COUNTY
ORDINANCE NO. 2010-10 TO INCLUDE NEW FEES, FEE INCREASES AND FEE
RESTRUCTURING FOR SERVICES PROVIDED THROUGH THE IMPLEMENTATION OF
THE MOHAVE COUNTY ZONING ORDINANCE, INCLUDING BUT NOT LIMITED TO

AUTOMATION FEES,AND TO INCLUDE NEW FEES AND FEE INCREASES FOR SERVICES
PROVIDED THROUGH THE IMPLEMENTATION OF THE MOHAVE COUNTY LAND
DIVISION REGULATIONS, FORMALLY INCLUDED IN MOHAVE COUNTY ORDINANCE
NO. 2010-07.

WHEREAS, at their meeting on June 18, 2018, the Board of Supervisors held a public hearing to
determine whether approval should be granted for an amendment to Mohave County Ordinance No. 2010-
10 regarding fees for services, and

WHEREAS, the Mohave County Development Service Department is seeking to increase the
current fee schedule for services provided through both the Mohave County Zoning Ordinance and the a
Mohave County Land Division Regulations to meet the current market demands. Development Services
is also looking to simplify the Mohave County Ordinance by combining both the Zoning Ordinance fees
and the Land Division Regulations fees, and
WHEREAS, the last time that the fees, for services provided through the implementation of the
Mohave County Zoning Ordinance, were increased was September 4, 2007, with BOS Resolution No.
2007-440, except for the Automation Fees. The Automation Fees were established on August 1, 2005,
via Mohave County Ordinance 2005-10 and have not been increased since, and
WHEREAS, Mohave County Land Division Regulations were increased August 1, 2005, with
BOS Resolution No. 2005-445, and
WHEREAS,the Board approved a fee schedule at their meeting on August 7, 2017, and

WHEREAS, at their meeting on November 6, 2017, the Board of Supervisors reconsidered the
fee schedule and referred the proposal back to the Development Services Department and the Planning
and Zoning Commission for additional public participation as specified in a public participation program,
and
WHEREAS, the Board adopted a public participation program at their meeting on December 4,

WHEREAS, the public participation plan has been implemented as approved, including five
public meetings held throughout Mohave County, and
WHEREAS,the Planning and Zoning Commission discussed the fee schedule at their meeting on
February 14, 2018 and asked the Board for guidance on the fee strategy, and
WHEREAS, at their meeting on April 2, 2018, the Board approved a fee schedule strategy, and
set a Public Hearing on the fee schedule for June 18, 2018, and
WHEREAS,the Planning and Zoning Commission recommended approval of the fee schedule at
their meeting on May 9, 2018, and
WHEREAS, the proposed fee schedule has been posted on the Mohave County webpage for 60
days as required by A.R.S.§11-251.13,and the public hearing was advertised in the Kingman Daily Miner,
The Spectrum, the Mohave Daily News and the Today's News Herald on June 3, 2018. The Notice of
Public Hearing was posted throughout Mohave County on June 1, 2018.
NOW THEREFORE BE IT ORDAINED, that the Board of Supervisors at their regular meeting on
Monday, June 18, 2018, APPROVED this Ordinance amending Mohave County Ordinance No. 2010-10
as follows (language to be deleted is std, and language to be added is bolded and double underlined):

C. Open lot uses and change of use shall require a$100 fee for their establishment.
d. Temporary Tr-avel-r,ailef Recreational Vehicle shall require a$50 5100 fee for
the permit allowing the initial setting of the Recreational Vehicle, and a 50
fee annually, thereafter, provided no longer than 15 months between permit
renewals.
e. A home occupation permit shall be issued to the applicant and is nontransferable.
The permit must be renewed annually with a payment of$-58$100 (Home
Occupation Fee) for the initial permit and $50 annually thereafter,provided
that the Home Occupation is not substantially changed.
Square footage of multi-storied structures shall be the total accumulative square footage for all
levels.
8. Sign fees. The fees for outdoor advertising signs shall be based on the area of the sign as
follows:
Up to 15 square feet $45

or phrase interpretation,plan amendment, initial submission of a site plan or
subdivision plat, requests for extensions and fesolutio amendments of resolutions,
and rezoning or zening special or conditional use pen-nit-application submitted.-umde-r

44-. 16. The Plaftning Development Services Director shall at the request of an applicant
send all or any part of the review process for specific zoning plans, site plans,
planned area developments and planned community developments to an outside
review contractor chosen through the appropriate procurement process. The fee
for any plan or plat sent to the review contractor shall be the cost of the contract
review plus the normal fee as stated in this ordinance. (Changed with BOS
