'...-:- .'''- ~;" '-=-~'''.- ... ~...- ...- ....._~.:. .-' . ? .. ~ 1) :'~,n :":",,,j~.:,. ........,'....1 ,..:.'1' b~~~:! ~~1 .'.:,'''::'~ . ."~ i -..-::-:~ ,,1 ,. ..# : ' i '-- . ."'- . ~.,-~~_.,~ ~ ~ ~-~ MICROtlLMbI RESOLUTION NO. 90-58 RESOLUTION SETTING FORTH APPROVAL OF A PRELIMINARY SUBDIVISION PLAN FOR EMERALD RIVER ESTATES, TRACT 4093, BEING A PORTION OF THE N~ OF THE NE% SECTION 25, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 5, 1990, a public hearing was conducted to determine the approval of the preliminary subdivision plan and drainage report for Emerald River Estates, Tract 4093, being a portion of the N~ of the NE% of Section 25, Township 19 North, Range 22 West, and WHEREAS, the owner/developer of this tract is Doug Cain, Bullhead City, Arizona. The Engineer responsible for the preparation of the drainage report and design of this subdivision is RaYmond W. Stadler, P.E., McLaughlin Kmetty Engineers, Ltd., Glendale, Arizona, and WHEREAS, the applicant is intending to develop this property for single family homes only and does not desire mobile home occupancy, and WHEREAS, this property's western border lies 1570 feet east of Mountain View Road, while it's eastern border is located 1060 feet further to the east. It's northern border is El Rodeo Road and 1320 feet to the south lies the southern boundary. P. 2 OF 5 BOOK 1680 PAGE 285 (FEE~ 90- 14423) Resolution No. 90-5B Page 2 is mostly zoned A-R (Agricultural Residential/One Acre Minimum Lot Size), with numerous subdivisions in the area. There is one (1) R-MH/BM (Residential Mobile Homes/Eight Thousand Square Foot Minimum Lot Size) zone fronting El Rodeo Road, and is located B29 feet west of the subject property. This proposed 132 lot subdivision is not within delineated flood zone as shown on the FEMA flood insurance rate map for Mohave County, and WHEREAS, the Commission has considered the drainage plan as submitted by the project engineer and as evaluated by the County Engineer, and WHEREAS, the Commission at their meeting on February 14, 1990 did recommend conditional approval of the preliminary subdivision plan for Tract 4093 based on the understanding of the Mohave County Planning and Zoning Commission that all streets within the subdivision including the access road will be constructed and paved with asphaltic concrete in accordance with standard specifications #101.10D and #171 of the County Engineering Road Standards or better, the interior streets will include rolled curb. A water supply and distribution system including adequate pressure and volume for fire flows will be constructed to serve each lot. Grading and drainage related improvements will be made as recommended by the design engineer. All lots and street centerline monuments will be staked and monumented in accordance with standard specification No. 102 of the County Engineering Road Standards. Fire hydrants will be provided at locations prescribed by the Fort Mojave Mesa Fire Department; and, as a condition of approval, the owner/developer is responsible for the completion of improvements and shall provide an assurance for all required subdivision improvements in accordance with Article V of the Subdivision Regulations, and WHEREAS, further conditions of approval are as follows: 1. The right-of-way from the State Land Department for the access road should be acquired prior to recordation. 2. If the triangular sliver of land north of lot 1 is acquired from the state, a non-access easement will need to be provided adjacent to the El Rodeo Road right-of-way. 3. The eight (B ') foot PUE must be provided along all street lines. A petition of exception will need to be submitted requesting the use of an eight (B') PUE as per Mohave County Subdivision Regulations. 4. A petition of exception must be submitted for the long block (lots B2 - 107) as per Mohave County Subdivision Regulations. 5. Tract A must be revised to Parcel A and its intended purpose shown (i. e. , continuation allowance for Mullholland Road). 6. The CC&R's will need to be submitted with the appropriate fees before final recordation. 7. The detailed drainage report submitted has had several comments from the county engineer which may require more than minor changes to the overall design of this subdivision preliminary plan. If in the opinion of staff these changes are significant, then the owner/subdivider shall be required to submit a revised preliminary plan in accordance with 3.B-B of the Mohave County Subdivision Regulations for review by the Planning and Zoning Commission. 9. The septic system design must confo~m with all provisions of Engineering Bulletin 12 from ADEQ. Approval of the design will be predicated upon each lot in this subdivision meeting a four (4) bedroom home and shall allow for a 100% reserve area on each lot for trench. Before recordation the $50.00 plan review fee must be paid to County Environmental Health for service review rendered. 10. Staff recommends a minimum of ten (10') foot side lot building set backs on all double-fronted lots in this subdivision and that each lot meet Section 25 A.4 (pg. 43) of the Mohave County Zoning Regulations. The following standard conditions are noted that apply to all submittals at this stage: A. The developer will make the same commitments for improvements in the prospectus to the State Real Estate Commission as is required for approval of this tract by the Board. B. Arizona Department of Water Resources determines that there is adequate water supply to serve this subdivision. C. Arizona Department of Environmental Quality approves the water supply and distribution system. D. The water system will provide adequate flows for fire protection. Fire hydrants conforming to the minimum County standards shall be provided and located no more than eight hundred (BOO') feet apart and/or fire hydrants acceptable to the Fort Mojave Mesa Fire Department at the locations they prescribe. . . ~ OF ~ 1680 PAGE 288 (fEE~ 90- 1~~23) ("",'1 I,':~: I... t ~::; '"', r;:,g 6':':":; Resolution No. 90-SB Page 5 E. The owner/subdivider shall cause the drainage related improvements to be completed as recommended by the project engineer, with changes as noted by the County Engineer/Floodplain staff and outlined in the detailed drainage report. F. The Mohave County Planning and Zoning Commission recommends that the Board of Supervisors approve a zone change prior to recording the final plat; G. The minimum lot size shall be 9, 5B5 square feet in area. H. Tracts listed within the subdivision be changed to Parcel per the Mohave County Subdivision Regulations.
