A RESOLUTION SETTING FORTH APPROVAL OF A FINAL SUBDIVISION PLAN
FOR DESERT LAWN CEMETERY, TRACT(S) 1003 (AMENDED), 1003A
(AMENDED), 1003A2, 1003B, 1003L, 1003M, 1003P, AND 1003Q
SUBDIVISION(S) AND THEIR ASSOCIATED ZONING TO MODIFIED SPECIAL
DEVELOPMENT CEMETERY, BEING PORTIONS OF SECTION 5, TOWNSHIP 17
NORTH, RANGE 21 WEST, GILA & SALT RIVER BASE & MERIDIAN, LOCATED
IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA
I,
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on February 5, 1990, a public hearing was
conducted to determine the final subdivision plan( s), for the
subdivision known as Desert Lawn Cemetery, Tract(s) 1003
(amended), 1003A (amended), 1003A2, 1003B, 1003L, 1003M, 1003P,
and 1003Q, located three (3) miles east of Highway 95 and south
of Laguna Road, in the South Mohave Valley area, and
WHEREAS, information available to this Board indicates that
Desert Lawn Cemetery is now owned by Mohave Valley Service
Corporation.
The revised plans have been prepared by Jack
Stovall, P.E. of Stovall Engineering Corporation, on behalf of
Mr. James Kevin Hasset, dba Desert Lawn Funeral Home and Memorial
Gardens, and
WHEREAS, the Desert Lawn Cemetery is located three (3) miles
east of Highway 95, is east of Lagoon Estates, is ~ mile south of
Laguna Road and Fronts along the east side of Ranchero Lane, and

WHEREAS, in 1967 the Board of Supervisors approved a special
subdivision plan which subdivided forty
(40)
into
acres
relatively large lots (Lots A-P), dedicated, reserved and zoned
specifically for cemetery purposes. All lots were to be further
divided into cemetery plots except Lot G which was reserved for
maintenance facilities and/or other accessory uses, and
WHEREAS,
this
approval
granted
based
the
was
on
understanding that prior to the division of these designated lots
into grave sites or plots or used for internment, individual
subdivision plats would be prepared and recorded for each of the
lots, and
WHEREAS, in 1967 a final plat was approved and recorded
which subdivided Lot A into individual blocks and cemetery plots
for grave sites.
This plat dedicated Lot A in perpetuity, as a
cemetery, and
WHEREAS, in 1978 the Commission and Board approved a
preliminary subdivision plan intended to further divide Lot P
into grave sites in order to provide a specific area for
Veteran's groups.
The final plat for Tract 1003-P was never
recorded, and

WHEREAS, the original plans were prepared by Ralph Nunnelly,
P. E. of Coe & Van Loo Engineering on behalf of the Mohave

Internment Association, William La Follette as Representative,
and
WHEREAS, the new owner has submitted plans depicting a
resubdivision of the overall subdivision, or Tract 1003, and
WHEREAS, information available to the Commission indicates
that portions of Lot A, Lot P, and Lot Q are being used for
cemetery purposes, i.e., there are plots or urns buries within
these lots, and
WHEREAS, the remainder of the cemetery lots are vacant or
undeveloped except for the two (2) mobile home residences located
on Lot 0 along Ranchero Lane, and
WHEREAS, the revised plan depicts Lots A-Q.
All of these
lots are to be dedicated in perpetuity into cemetery lots for
internment purposes only, except Lots G, D, N, and 0, and
WHEREAS, the "revised" plan for Tract 1003 not only is
intended to correct surveying errors in previous maps and locate
the existing cemetery plots, the new owner proposes to change the
design and prescribed uses per the recorded plat for Desert Lawn

Cemetery, Tract 1003.
The revised plan proposes to change the
uses set forth in the Dedication on the recorded plat for Tract
1003, and
WHEREAS, a portion of Lots Hand F, dedicated for internment
purposes per recorded Tract 1003, are now identified on the
revised plan as Lot G which is the intended site of a funeral
home and mausoleum, and
WHEREAS, a portion of Lot C, dedicated for internment
purposes per recorded Tract 1003, is now identified as Lot D,
which is intended for a crematory, maintenance facility, and a
manager's residence, and
WHEREAS, Lots Nand 0 along Rancho Lane, below the rest of
the cemetery property, are intended to be used for a nursery,
florist shop, and an educational facility for teaching internment
procedures on-site, and
WHEREAS, Lots A, P, Q, and M are improved in that they have
been graded, an irrigation system installed, grass
has been
planted, and vegetative screening installed, and
WHEREAS, Desert Lawn Circle, a private road, has been
constructed and surface treated at the time the original

subdivision plan was approved.
No other site improvements are

proposed except for staking and monumenting the lots depicted on
this plan.
Additional site/improvements may be proposed and/or
required at the time the individual lots are further divided into
cemetery plots, and
WHEREAS, because of the special use of this property the
plans, as submitted, do not meet all design standards or
requirements of the Mohave County Subdivision Regulations. It
appears, however, that this subdivision, which is designed for
cemetery purposes, meets the intent of the Mohave County
Subdivision Regulations, and
NOW THEREFORE BE IT RESOLVED, that the Board approves the
said final plan condition to the following:
1. The owner/subdivider shall initiate action to abandon
or extinguish the Dedication per the final plat for
Desert Lawn Cemetery, Tract 1003, recorded on February
7, 1967 where all lots were dedicated in perpetuity for
subdivision into cemetery lots for internment purposes
only.
2. Prior to the subdivision of Lots A, B, C, E, F, H, I,
J, K, L, M, P, & Q into gravesites or plots, individual
subdivision plats will be prepared, approved, and
recorded for each lot.
3 .
The lots as depicted on this revised subdivision plan
must be staked and monumented in accordance with the
applicable Mohave County standards. An assurance will
be required for this site improvement.

4. A site plan shall be submitted by the owner and
approved by staff prior to permitting or constructing
the funeral home, mausoleum, maintenance facility, and
other special uses on the lots designated for said
special purposes on this preliminary subdivision plan.

5. A property owner I s and/or management association must
be formed to include rules and regulations for the
perpetual care of the cemetery plots, internment and
maintenance of site improvements in accordance with the
provisions of A. R. S. 32-2194 (Article 6. Organization
and Regulation of Cemeteries).

NOW THEREFORE BE IT FURTHER RESOLVED, upon receipt of or
evidence that these conditions have been met together with the
executed mylars and appropriate recording fees, the Director of
Planning and Zoning will obtain the necessary signatures from the
County Departments and officials and cause the final plat to be
recorded, and

NOW THEREFORE BE IT FURTHER RESOLVED, that notice of hearing
has been met and published throughout this subdivision process
and the public was afforded notice of this final action through
advertisement of the Board of Supervisor's meeting for this date.
