AeOORDS MICRDflLMW OF MOHlWE COUNTY, ARQONt\ NO. 90-17 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO ESTABLISH A SINGLE FAMILY RESIDENCE IN A C-1/S-D (NEIGHBORHOOD COMMERCIAL/SPECIAL DEVELOPMENT) ZONE ON WT 16, BLOCK 164, NEW KINGMAN ADDITION 110, TRACT 1103, LOCATED IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held January 8, 1990 a public hearing was conducted to determine whether approval should be granted to Matthew J. and Anna Marie Puett, Kingman, Arizona for a Zoning Use Permit to establish a single family residence in a C-1/S-D (Neighborhood Commercial/Special Development) zone, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on December 13, 1989 did generate a recommendation of approval of the request with the following conditions: 1. If construction or use has not commenced within one (1) year of the Board of Supervisor's approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date; 2. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare; 3. That a Zoning/Building Permit be obtained; 4. This home shall be used as a residence only and shall not be used in conjunction with the underlying C-1 (Neighborhood Commercial) or SD-C (Special Development- Commercial) zoning. If the underlying C-1 or SD-C zoning were to be exercised by the owner of the property, then a rehearing ~f this Zoning Use Permit would be required; BOOK 1653 f ,~LE 274 ,C, - --...., ~' f'. . Mobile homes are specifically prohibited on this parcel by the conditions set for the underlying zoning; and WHEREAS, this property is located in the New Kingman Addition with access via the intersections of Lomita Street or North Bond with Carver Avenue. This property is approximately 210 feet east of North Bond Road and is Lot 16, on the south side of Carver Avenue. Originally the zoning of this block was set as a Special Development with a Commercial designation. However, no Zoning Plan was developed and the Planning Commission must have had the overall plan in mind as they developed a fall back position of C-1 (Neighborhood Commercial) if no plan was approved by the Commission. Thus, this Zoning Use Permit application is in order under C-1 (Neighborhood Commercial) criteria. Mobile homes are specifically prohibited in this block by the enabling zoning. There are several single family residences in this area. Also, there is a SD-R/R-M (Special Development- Residential/Multiple Family Residential) zone nearby that has single family residences. It would not be unusual to this area to allow this residence, and WHEREAS, the notice of hearing was published in the Mohave Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on December 22, 1989 as required by the Arizona Revised Statutes and the Mohave County zoning Regulations, and 600~ 1653 fH'[ 2.75
