A RESOLUTION DEFINING THE ENFORCEMENT OF THE BUILDING CODE IN
MOUAVE COUN'l'Y. SPECIFICALLY THAT ALL NONRESIDENTIAL, COMMERCIAL,
MANUFACTURING, INDUSTRIAL AND ASSOCIATED SITE STRUCTURES,
DUPLEXES, AND OTHER MULTIPLE FAMILY RESIDENTIAL STRUCTURES WITHIN
MOlffiVE COUNTY ARE SUBJECT TO THE CODE EXCEPT AS EXEMPTED BY THE
CODE AND IDENTIFIED HEREWITH.

WHEREAS, the Board of Supervisors may authorize that areas
zoned rural or unclassified may be exempt from provisions of code
adoption, and
WHEREAS, the State, through its authority granted to the
county, did not specify that areas containing nonresidential
zones within rural areas can be exempted, and
WHEREAS,

defined in Mohave
County Zoning
Regulations as "A" (General), "A-R" (Agricultural-Residential)
and "R-E" (Residential-Recreation, to the effect that it permits
animals), and

WHEREAS, when any area is rezoned from a rural to a non-
rural zone (except those areas rezoned for single family
dwellings only), or if it is specifically designated as other
than rural under the current zoning scheme (except as noted
above), it should come under the building code automatically, as
it follows that the primary charge of this Political Subdivision
is to protect the Health, Safety and Welfare of its citizenry,
and
WHEREAS, the citizens of this county and its visitors should
feel confident that structures they might enter or use be
constructed to meet specific health and safety codes. That

structures intended for occupancy by the public, being commercial
by nature or multifamily meet the Uniform Building Code, and
NOW THEREFORE BE IT RESOLVED, that Pursuant to its power
under A.R.S. 11-861, the Board of Supervisors at their special
meeting on February 20, 1990 approved this amendment to the
current

identified building overlay zones), commercial, manufacturing,

industrial, and associated site structures, duplexes and other
multiple family residential structures that currently lie outside
of the approved delineated Building Code Overlay zones, to be a
part of those overlay zones, and
NOW THEREFORE BE IT FURTHER RESOLVED, that the Board of
Supervisors by this action is addressing the Health, Safety and
Welfare of its citizenry by the application of the Building Codes
as specified herein, and that this amendment shall be in effect
upon its passage.
