RESOLUTION NO. 90-122 A RESOLUTION REZONING THE WEST 2/3 OF THE W~ PARCEL 4, SECTION 12, TOWNSHIP 21 NORTH, RANGE 19 WEST, KNOWN AS PARCEL 4A, FROM: A-R/10A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/4A (AGRICULTURAL-RESIDENTIAL/FOUR ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MOllAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 7, 1990, a public hearing was conducted to determine whether approval should be granted to Charles & Nancy Palermo, Kingman, Arizona, for a rezoning from existing A-R/10A (Agricultural-Residential/Ten Acre Minimum Lot Size) zone to A-R/4A (Agricultural-Residential/Four Acre Minimum Lot Size) zone, located in the Golden Valley area, and WHEREAS, this rezone is located approximately seven & one- half (7.5) miles west of the junction of Highways 93 & 68. This portion of Parcel 4, known as Parcel 4A, is an approximately twelve (12) acre parcel located at the northeast corner of Highway 68 and Davis Road. This area is mostly zoned A-R/10A (Agricultural- Residential/Ten Acre Minimum Lot Size). Parcels 4A and 4C were approved for a C-2H (Highway Commercial) zone to a depth of three hundred (300') feet via Resolutions P&ZC: 79-81 and 79-82. These resolutions conditioned the approval to allow for a two (2) acre t. I I minimum lot size and a right-of-way dedication on the western border of this parcel (4A) and the eastern border of the Garaci parcel (4C), and WHEREAS, this property does not appear to be within a designated floodplain, however, a visual inspection of this site indicates a tributary wash running through this property. This property is within the Golden Valley Improvement District, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on April 18, 1990 did generate a recommendation of approval of the zone change request with the following conditions noted: 1. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 2. The establishment of minimum lot areas based on the size of the parcels per the recorded Parcel Plat. 3. Each parcel shall have legal access. 4. Each parcel shall meet or exceed four (4) acres exclusive of road easements. ... . "- .. Resolution No. 90-1i2 . / Page 3 f' '.: ::\~:< :1f~ h~;;'~' ,l~,~./ ;l!'i,t,~ That the Board of Supervisors accept the Dedication of a forty-two (42') right-of-way and an eight (8') foot public utility easement along Chino Road as it is contiguous to this property and the Board accept the thirty (30') foot dedication of Davis Road as it is contiguous to the western side of the property through the approval of the resolution authorizing this zone change, and that the dedication statement and dedication(s) be shown on the Parcel Plat. 6. That the northern most parcel be four (4) acres exclusive of right-of-way easements; that the southern most three hundred (300') feet be established as the C- 2H (Highway Commercial) as per Resolution P&ZC: 79-81 and the balance acreage be one (1) parcel. 5. 7. That any surface drainage be noted on the Parcel Plat. 8. Such zone change shall not be effective for at least thirty (30) days after final approval of the change in zoning classification by the Board, being June 6, 1990, as per A.R.S. 11-829E. f'f? t'~;i)l WHEREAS, the notice of hearing was published in the Mohave (:b' Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on April 1, 1990, and posted March 30, 1990 as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 7, 1990 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
