PAGE 1 OF 3 80S RECORDING FEE 0.00 NC RESOLUTION NO. 90-118 A RESOLUTION FOR THE EVALUATION OF A REQUEST FOR A PETITION OF EXCEPTION FROM TilE MOHAVE COUNTY SUBDIVISION REGULATIONS REGARDING OFFSET STREET INTERSECTIONS AND DOUBLE FRONTED LOTS FOR COURTNEY GREENS, TRACT 4054, A REVISION OF THE APPROVED PRELIMINARY PLAN WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held May 7, 1990 a pub1 ic hearing was conducted to evaluate a petition of exception from the Mohave County Subdivision Regulations regarding offset street intersections and double fronted lots for Courtney Greens, Tract 4054, @1ii located in the South Mohave Valley area, and f<H~J Fir- " !:}:~: WHEREAS, Courtney Greens, Tract 4054, was approved as a preliminary subdivision plan. This approval included a specific street design north of a drain channel. A Final Plan, Tract 4054-A, was submitted for a part of the approved preliminary plan along Baronsgate Way and is recorded. Before any other part of the tract was recorded, agreements were reached on the construction of E1 Rodeo Drain, and WHEREAS, the extent of right-of-way for the drain channel necessitated that a revised plan be approved in the form of a final map of Courtney Greens. Page 2 WHEREAS, staff feels that after review of the traffic patterns, it would serve no good purpose to approve a plan which could cause congestion along an arterial as suggested, and WHEREAS, the proposed redesign creates a series of offset intersections along a major collector street, Aztec Road. Calle Del Media is a major north- south midsection road, and WHEREAS, the Planning and Zoning and County Engineering staffs proposed a redesign (attached exhibit) which eliminated the multiple intersection on Aztec Road, an arteri a 1, increased the number of lots avail ab 1 e to the owner/subdivider, took into account the design of the El Rodeo Drain, and eliminated a one (I') foot non-vehicle access with associated barrier across three (3) lots, and WHEREAS, the project engineer for the owner/subdivider rejected the staff proposal and approached the Planning and Zoning Commission with a variation of the original request (see attached exhibit, combined with staff proposal), and WHEREAS, the owner / subd i v i der is the owner of subd i vi ded property north of this project, thus is able and agreeable to changing the design of roadways in that proposed tract, and WHEREAS, this proposal does not meet the letter of our regulation as the new intersection would be within one hundred ninety-five (195') feet of the intersection of Calle Del Media instead of the two hundred (200') feet minimum stated by Regulation, the actual roadway can meet the minimum design, and ,~ 'j PAGE 2 OF 3 BK 1716 PG 66 (FEE090- 30508) .. ~....- ;t,~a ,>'J-'.; ('Wi! -~ Resolution No. 90-118. . Page 3 WHEREAS, the Planning and Zoning Commission did take this into consideration as well as note that this request would probably require the establishment of a one (1') foot non-vehicle access with associated barrier along Calle Del Media, and WIIEREAS, the Commission did not feel that the approval of this new request would be detrimental to the public welfare or injurious to other adjacent properties and this request would not nullify the intent or purpose of the Master Plan of the County or other regulations because it will still allow good traffic flow within these developments, and WHEREAS, the Planning and Zoning Commission did unanimously approve the amended design presented at the Commission meeting by the owner/developer through his engineer, Jack Stovall, and recommend same to the Board of Supervisors, and \ NOW TUEREFORE BE IT RESOLVED, that the Board of Supervi sors, at thei r regular meeting on Monday, May 7, 1990 approved this Petition of Exception as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
