PAGE 1 OF 3 BOS RECORDING FEE 0.00 NC . .:~ ~,. :', ;.:, RESOLUTION NO. 90-109 (, A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO ESTABLISH A NIGHT WATCHMAN'S QUARTERS IN A C-2 (GENERAL COMMERCIAL) ZONE IN THE NW% NW% SECTION 21, TOWNSHIP 14 NORTH, RANGE 20 WEST, LOCATED IN LAKE HAVASU, MOHAVE COUNTY, ARIZONA ( WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held May 7, 1990 a public hearing was conducted to determine whether approval should be granted to Gale Marsh, Lake Havasu City, Arizona for a Zoning Use Permit to establish a night watchman's quarters in a C-2 (General Commercial) zone, and WHEREAS, the subject property is located approximately one (1) mile north of the Lake Havasu City corporate limits on the west side of Highway 95. The applicant intends to establish a night watchman's residence in order to stop "speeding cars and trash dumpers", and WHEREAS, the area surrounding this development consists primarily of commercial uses, however, there is a residential subdivision located approximately seven hundred (700') feet south of this request. A watchman's residence may be permitted in a C- 2 (General Commercial) zone with an approved Zoning Use Permit as per Section 21.C.1 of the Mohave County Zoning Regulations. This request is not unusual and would not be contrary to the County's ~ !~.' ".,.,,1 . j1('.";.) ',;~Y; J:~ 1:R1i .> .'~. l ., i.'.",'"'"l .(t~ ~Lil] . . 2 OF BK 1716 PG 3 33 (FEE~90- 30498) Resolution No. 90-109 Page 2 Zoning Ordinance as long as the applicant complies with all applicable provisions therein, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on April 18, 1990 did generate a recommendation of approval of the Zoning Use Permit with the following conditions: 1. The applicant comply with all applicable provisions of Section 25, 26, 27, & 31 of the Mohave County Zoning Regulations. 2. If construction or use has not commenced within one (l) year of the Board of Supervisors approval of the ZUP or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 3. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 4. That a zoning/Building Permit be obtained. 5. This structure shall be used as a night watchman 's residence only in conjunction with this C-2 (General Commercial) development and shall not be used for rent, lease, or sale separate from the primary purpose of the development. 6. Compliance to the Building and Zoning Codes shall be mandated for this development before this Zoning Use Permit can come into effect. WHEREAS, the notice of hearing was published in the Mohave Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on April 1, 1990 and posted March 30, 1990 ~ '. . . J OF 3 1716 PG 34 (FEEt90- 30498) Resolution No. 90-109 Page 3 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 7, 1990 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, subject to th7 conditions outlined herein.
