PAGE 1 OF 3 B09 RECORDING FEE 0.00 Ne RESOLUTION NO. 90-10B A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO ESTABLISH A MOBILE HOME IN A C-2 (GENERAL COMMERCIAL) ZONE IN THE NW% OF THE SW% OF THE NW% SECTION 33, TOWNSHIP 41 NORTH, RANGE 15 WEST, LOCATED IN THE ARIZONA STRIP, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held May 7, 1990 a public hearing was conducted to determine whether approval should be granted to Harry Gates, Kearns, Utah for a Zoning Use Permit to establish a mobile home in a C-2 ( General Commercial) zone, and WHEREAS, the subject property is located in the Littlefield area in the Arizona Strip. Access in this area is questionable, however many of the ingress/egress easements were established in the 1960's and might be considered as access. This property is accessible via the interchange of Old Highway 91 and 1-15, then north approximately one (1) mile to the "Combe" ingress/egress easement, west approximately one-quarter (1/4) mile to Arizona Avenue, north approximately one-half (1/2) mile to an unnamed private ingress/egress easement, then east approximately 550 feet to the subject property, and WHEREAS, the applicant purchased this property in April, 1989 and subsequently split it in October, 1989. C. 1 of the Mohave County Zoning Regulations. This area was zoned C-2 (General Commercial) more than twenty (20) years ago and had developed with a number of commercial and residential uses when Highway 91 was a major highway. After being bypassed by Interstate 15, this area developed as a resort/retirement community which includes numerous homes, mobile homes, and mini R-V parks. This property may not be adequate for commercial development, thus, residential uses may be more sufficient for this area, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on April 18, 1990 did generate a recommendation of approval of the Zoning Use Permit with the following conditions: 1. If construction or use has not commenced within one (1) year of the Board of Supervisors' approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 2. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. 3. That a Zoning/Building Permit be obtained. 4. No zoning/Building Permits shall be obtained for a commercial structure or use of this property unless or until the mobile home residence is removed. ..,. ~- ~ .... . ..," A 3 OF B . 716 PG 3 31 (FEEI90- 30497) Resolution No. 90-108 Page 3 5. The mobile home shall have an affixed "HUD" label certifying that the unit has been manufactured as a mobile home. 6. That the underlying C-2 (General Commercial) zoning may not be used on this parcel while the residential use remains. WHEREAS, the notice of hearing was published in the Mohave Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on April 1, 1990 and posted April 2, 1990 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations, and ~. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, toAd (.::'lJ: at their regular meeting on Monday, May 7, 1990 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
