A RESOLUTION REZONING OF THE NE~ SW~ PARCEL 227, SECTION 4,
TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM: A-R/2A (AGRICUL'l'URAL-
RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-
R/IA (AGRICULTURAL-RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE,
LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on April 2, 1990, a public hearing was
conducted to determine whether approval should be granted to
Richard Wilson, G.W. Investment Company, Phoenix, Arizona, for a
t~j rezoning from existing A-R/2A (Agricultural-Residential/Two Acre
Minimum Lot Size) zone to A-R/IA (Agricultural-Residential/One
Acre Minimum Lot Size) zone, located in the Golden Valley area,
and
WHEREAS, this rezone is located approximately 4.5 miles west
of the junction of Highways 93 and 68, approximately 1 mile north
of Highway 68, 330 feet east of Magma, between Burro and Chino
Drives.
Legal access is provided by Highway 68 west, Maverick
Road north, Destiny Way approximately 660 feet east to the
northeast corner of this property.
These roads are open and
bladed, and

WHEREAS, this area has a mix of residential uses, however,
mobiles are the predominant characteristic in this area's
landscape. This lot is currently occupied by a mobile. This zone
change is being requested so that building permits can be
obtained and residences established on each of the lots which
would be created by the proposed splits. An investigation of the
floodplain maps reveal this property does not show up in a major
flood zone.
This property is within the Golden Valley
Improvement District, and
WHEREAS, a public hearing before the Mohave County Planning
and Zoning Commission on March 14,
1990 did generate a
recommendation of DENIAL of the zone change request, and
WHEREAS, the Planning and Zoning Commission, in their review
of this proposal, did not feel that access afforded by an
Ingress/Egress, Public Utility Easement that totaled forty-five
(45') feet in width to the eastern edge of the property was
adequate public access.
Furthermore, since the applicant or a
representative was not available to ascertain whether the
purchase and dedication of legal access could be accomplished,
they felt it necessary to recommend DENIAL, and

WHEREAS, the notice of hearing was published in the Mohave
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona on March 18, 1990, and posted March 16,
1990 as required by Arizona Revised Statutes and the Mohave
County Zoning Regulations, and
WHEREAS, the Board of Supervisors, after review of this
proposal, did overturn the recommendation of the Planning and
Zoning Commission with the following conditions noted:
1. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
2.
The establishment of minimum lot areas based on the
size of the parcels per the recorded Parcel Plat.
3. Each parcel shall have legal access.
4. Each parcel shall meet or exceed one (1) acre exclusive
of road easements.
5. The Parcel Plat shall show any surface drainage ways or
FEMA zones.
6. That the Board of Supervisors accept the dedication of
a thirty ( 30 ') foot Right-of-way along the northern
boundary of this property to be shown on the plat.
Also, this plat shall indicate access is provided by
Destiny Way which is the ingress/egress to the eastern
boundary of this property through the approval of the
resolution authorizing this zone change and that the
dedication statement and dedication(s) be shown on the
plat.
7.
Such zone change shall not be effective for at least
thirty (30) days after final approval of the change in
zoning classification by the Board, being May 2, 1990,
per A.R.S. 11-829E.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors
do recognize that the Planning and Zoning Commission does
thorough evaluations of cases before them, that the applicant was
in attendance at the Planning and Zoning Commission meeting, but
failed to step forward and be recognized, and that information as
presented by the applicant at the Board of Supervisors' hearing
would have been useful in the final determination by the
Commission, and
NOW THEREFORE BE IT FURTHER RESOLVED, that the Board of
Supervisors, at their regular meeting on Monday, April 2, 1990
