PAGE 1 OF 3 BOS RECORDIHG FEE 0.00 He RESOLUTION NO. 90-180 A RESOLUTION SETTING FORTH THE REZONING OF LOTS 1-6, BLOCK 181, TRACT 1104 AND LOTS 15-20, BLOCK 178, TRACT 1103, FROM: C-2 (GENERAL COMMERCIAL) ZONE, PROPOSED TO BE: R-l (SINGLE FAMILY RESIDENTIAL) ZONE, LOCATED IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 2, 1990, a public hearing was conducted to determine whether approval should be granted to Charles Clark, Burbank, California, for a rezoning from existing f/~~' i~~ C-2 (general Commercial) zone to R-1 (Single Family Residential) :~~!! ..tli.!' zone, located in the Kingman area, and WHEREAS, the subject property is located approximately one (1) mile north of the Kingman corporate limits at Gordon Drive and is approximately three-quarters (3/4) of a mile east of the Stockton Hill Road/Northern Avenue intersection. This property is located approximately 600 feet north of both the northeast and northwest corners of the intersection of North Bond Street and Northern Avenue. These lots are located at the southwest and southeast corners of the intersection of Neal Avenue and North Bond Street. Access is provided via several routes as this area has been developed for some time, and , ~i-'::';") . ~~AGE 2 OF 3 BK 1749 PG 415 (FEE~90- 45098) Resolution No. 90-180 Page 2 WHEREAS, the applicant is requesting this rezone in order to down zone the property to establish a single family land use zone, The current commercial land use for this vicinity has never developed as such and consequently the Planning and Zoning Commission and Board of Supervisors have heard and approved several Zoning Use Permits for residences on commercially zoned properties. The Planning and Zoning Commission was asked to clarify the Zoning Ordinance in regards to the down zoning of undesirable or outdated zoning at their May 9, 1990 meeting. As a result of the decision at that meeting, the applicant requested the elimination of the unnecessary commercial zoning, and .':;~ , :'i~4 ff';::-\) '" ~ .... :~,,~ . "" ,,~.,!:I WHEREAS, the property surrounding this request is zoned C-2 (General Commercial) on the south, R-1 (Single Family Residential) on the north and west, and R-M (Multiple Family Residential) on the west. Most commerc ial uses have not been utilized, thus, single family uses are the predominant characteristic in this area's landscape. There is a commercial structure being utilized on three (3) of the twelve (12) lots bordering the subject property's southern boundary, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on July 2, 1990 did generate a recommendation of approval of the zone change request with the . . The applicant comply with all applicable provisions of Section 25, 26, 27, & 31 of the Mohave County Zoning Ordinances. 2. Building/Zoning permit be obtained prior to construction or placement of any additional structures. 3. That a solid block wall be constructed as a buffer between the adjoining C-2 (General Commercial) area contiguous to this property's southern and eastern borders. 4. Such zone change shall not be effective for at least thirty (30) days after final approval of the change in zoning classification by the Board, being August 1, 1990, as per A.R.S. 11-829E. WHEREAS, the applicant understood and agreed to the conditions as stated above at the hearing, and l:'~~ WHEREAS, the notice of hearing was published in the Mohave (..~~ :.:~~ ''-_' Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on June 15, 1990, and posted June 15, 1990 as required by Arizona Revised Statutes and the Mohave County zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July 2, 1990 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
