PAGE 1 OF '3 BOS RECORDING FEE ~"'. -. :7~:~~~:; 0.00 He RESOLUTION NO. 90-176 A RESOLUTION SETTING FORTH THE REZONING OF THE SW~ SW~ SECTION 34, TOWNSHIP 21 NORTH, RANGE 19 WEST, FROM: A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/9A (AGRICULTURAL-RESIDENTIAL/NINE ACRE MINIMUM LOT SIZE) ZONE AND A-R/I0A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 2, 1990, a public hearing was conducted to determine whether approval should be granted to Robert and Darlene Fennel, Kingman, Arizona, for a rezoning from existing A-R/36A (Agricultural-Residential/Thirty-Six Acre Minimum Lot Size) zone to A-R/9A (Agricultural-Residential/One Acre Minimum Lot Size) and A-R/10A (Agricultural-Residential/Ten Ace Minimum Lot Size) zone, located in the Golden Valley area, and WHEREAS, the subject property is located approximately ten (10) miles west of the junction of Highways 68 and 93 and five (5) miles south of Highway 68 along the east side of Egar Road. The property occupies the northeast corner of Egar Road and Shinarump Drive, and .:::'....:,c" .~.y'l c;;;; ..'..... . ",," ,~ . . Resolution No. 90-176 PAGE 2 OF 3 BK 1749 PG 403 (FEE~90- 45094) Page 2 WHEREAS, there is an existing thirty (30') foot public utility easement running north-south through the center of this forty (40) acre parcel, and WHEREAS, review of Floodplain map #040058-2300B indicates a flooding potential for this property, and WHEREAS, this property lies within the Golden Valley Improvement District, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on July 2, 1990 did generate a reconunendation of approval of the zone change request with the following conditions noted: 1. That the western half of the current parcel be rezoned from A-R/36A to A-R/9A and the eastern half be rezoned from A-R/36A to A-R/10A. 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a m~n~mum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The two (2) western most parcels shall meet or exceed nine (9) acres exclusive of road easements. 6 . That the Board of Supervisors accept the dedication of a forty-two foot (42') right-of-way along Egar Road and Shinarump Drive with an eight foot (8') PUE along Egar Road and Shinarump Drive as it is contiguous to this property through the approval of the resolution authorizing the zone change, and that the dedication statement and dedication be shown on the Parcel Plat. 8. The Parcel Plat shall show any surface drainage and FEMA boundaries. 9. Such zone change shall not be effective for at least thirty (30) days after final approval of the change in zoning classification by the Board, being August 1, 1990, as per A.R.S. 11-829E. WHEREAS, the notice of hearing was published in the Mohave Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on June 15, 1990, and posted June 15, 1990 as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July 2, 1990 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
