PAGE 1 OF 3 BOS RECORDING FEE 0.00 Ne RESOLUTION NO. 90-171 A RESOLUTION SETTING FORTH THE REZONING OF LOTS 29 & 30 AND S~ LOT 28, BERMUDA VILLAGE, FROM: C-2 (GENERAL COMMERCIAL) ZONE, PROPOSED TO BE: C-MO (COMMERCIAL MANUFACTURING/OPEN LOT STORAGE) ZONE, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 2, 1990, a public hearing was conducted to determine whether approval should be granted to Larry & Kathleen Lively, Mohave Valley, Arizona, for a rezoning from existing C-2 (General Commercial) zone, to C-MO (Commercial Manufacturing/Open Lot Storage) zone, located in the South Mohave Valley area, and WHEREAS, the subject property is located within the Bermuda village subdivision. Bermuda Village is located three-quarters (3/4) mile south of Bermuda Meadows and is in the vicinity of the Needles Bridge. This tract is bounded by village Drive to the north, Barrackman Road to the east, Plantation Drive to the west, and Levee Way to the south, and WHEREAS, Lots 29 & 30 and the S~ of Lot 28 are located one ~~~ ':--t~ ( 1) block west of Barrackman Road and approximately 1,000 feet ":"...;i ~~ north of Levee Way. These parcels are located approximately 100 , --- . . Resolution No. 90-171 PAGE 2 OF 3 BK 1749 PG 388 (FEE~90- 45039) Page 2 feet south of the southeast corner of Bermuda Court and Village Road to Village Drive, and WHEREAS, all of the lots fronting Barrackman Road and Levee are zoned C-2 (General Commercial) and have developed with retail and service businesses or are vacant. The lots fronting Bermuda Court are also zoned C-2 (General Commercial) except for Lots 35- 45 which were zoned C-MO (Commercial Manufacturing/Open Lot Storage) via Resolution P&ZC: 89-54. There is an automobile garage located on the southeast corner of Village Drive and Bermuda Court, and WHEREAS, the applicant has recently purchased the subject property and is requesting this rezone in order to establish a distribution warehouse which use requires open lot storage. The Zoning Ordinance requires that C-MO (Commercial Manufacturing/Open Lot Storage) zone properties have 10,000 square foot minimum lot size when serviced by a franchised water system, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on July 2, 1990 did generate a recommendation of approval of the zone change request with the "",.--..+,'-"--" ---~---._-".. ~--,~~-, -, _._- ,.....,..-...,.-.,.....""....,...- following conditions noted: ~ Page 3 PAGE 3 OF 3 BK 1749 PG 389 (FEE~90- 45089) t" --=, Resolution NO.9. 71 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. 2. Such storage shall be completely enclosed by a view- obscuring fence which extends two (2') feet above the highest item to be stored, with a minimum of six (6') feet and a maximum of eight (8') feet in height. Such a fence shall display no advertising. 3. Any open lot storage must be related to or be an accessory to the primary business. 4. The applicant shall pave the driveway access and parking in accordance with Mohave County Standard Specification #171, or better. The storage area shall be covered with a dust-proof surface. If crushed rock is used for the dust-proof surface then the soil shall be maintained in a weed free condition. 5. The applicant shall obtain a building permit. 6. Such zone change shall not be effective for at least thirty (30) days after final approval of the change in zoning classification by the Board, being August 1, 1990, as per A.R.S. 11-829E. WHEREAS, the notice of hearing was published in the Mohave Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on June 15, 1990, and posted June 15, 1990 as required by Arizona Revised Statutes and the Mohave County zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July 2, 1990 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
