PAGE 1 OF 3 BOS RECORDING FEE 0.00 Nt RESOLUTION NO. 90-168 A RESOLUTION REZONING OF THE NE~ NW~ SECTION 36, TOWNSHIP 19 NORTH, RANGE 22 WEST, TO BE KNOWN AND SUBDIVIDED AS CASAS DEL SOL, TRACT 4107, FROM: A-R (AGRICULTURAL-RESIDEN'.fIAL) AND R-MH (RESIDEN'l'IAL MOBILE HOMES) ZONES, PROPOSED TO BE: SD /PUD /R-O (SPECIAL DEVELOPMENT/PLANNED UNIT DEVELOPMENT/SINGLE FAMILY RESIDENTIAL/MOBILE HOMES PROHIBITED) ZONE, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 2, 1990, a public hearing was conducted to determine whether approval should be granted to Joy Lane 40 Limited Partnership, Scottsdale, Arizona for a rezoning from existing A-R (Agricultural-Residential) and R-MH (Residential Mobile Homes) to SD/PUD/R-O (Special Development/Planned Unit Development/Single Family Residential/Mobile Homes prohibited) zone, located in the South Mohave valley area, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on June 6, 1990 did generate a recommendation of approval of the request with the following condition noted: 1. That the ZONING PLAN be approved for a SD/PUD/R-O (Special Development/Planned Unit Development/Single Family Residential/Mobile Homes Prohibited) in accordance with Section 19 of the Mohave County Zoning Regulations. 4. The establishment of minimum lot area based on the size of the parcels per the recorded Final Plat. 5. The owner accepts that whenever a "SD" zone is granted, each phase or stage of development and building proposals shall be submitted to the planning staff, to be evaluated and compared with the approved zoning plan before any permits may be granted. 6. Any significant change (as determined by the Planning Director - appealable to the Planning Commission) in the approved zoning plan shall require a rehearing on the change before the Commission, with a final determination to be made by the Board. 7 . Staff will maintain the most current approved ZONING PLAN on file in the master zoning folder for reviews. 8 . The use of this property may not be changed by the owner/developer or subsequent owners as it is approved unless subsequently approved by the Board in accordance with Arizona Statutes Annotated, Title II, Chapter 6, Section 11-832. 9. The rezone shall become effective upon the recordation of the Final Plat. WHEREAS, the notice of hearing was published in the Mohave Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on June 15, 1990, and posted June 15, 1990 as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, and -".,--~;,.~. ," . . Resolution No. 90-168 PAGE 3 OF 3 BK 1749 PG 380 (FEE~90- 45087) Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July 2, 1990 approved this change in zoning as recommended by the MohaveCounty Planning and Zoning Commission.
