PAGE 1 OF 4 BOS RECORDING FEE 0.00 Ne RESOLUTION NO. 90-167 1< r$C 1 (-\ ; <E >,) 9~ - j RESOLUTION SETTING FORTH APPROVAL OF A PRELIMINARY SUBDIVISION PLAN FOR CASAS DEL SOL, TRACT 4107, BEING THE NE~ OF THE NW~ SECTION 36, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MORAVE COUNTY, ARIZONA \ ~ t WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 2, 1990, a public hearing was conducted to determine the approval of the preliminary subdivision plan, petition of exception, and drainage report for ,~,~ "~ ~~6 Casas Del Sol, Tract 4107, a subdivision of the NE~ of the NW~ Section 36, Township 19 North, Range 22 West, and WHEREAS, the owner/developer of this tract is Joy Lane 40 Limited Partnership, Scottsdale, Arizona. The Engineer responsible for the preparation of the drainage report and design of this subdivision is Jack Stovall, P. E., Stovall Engineers, Inc., Bullhead City, Arizona, and WHEREAS, this proposed subdivision consists of forty (40) acres subdivided into 127 lots with a maximum lot size of 9,000 square feet and a minimum lot size of 5,000 square feet with a density of 3.17 lots per acre. Tract 4107 lies within a FEMA designated Zone A Flood Plain, and . .:~ "_o."''';!':. ..~.u~.r. . ~;. - .....,- , . ~AGE 2 OF 4 BK 1749 PG 37~ (FEE~90- 45086) Resolution No. 90-167 Page 2 WHEREAS, reviews of this preliminary subdivision plan have been received from the County Engineer, the Mohave County Health Department, the Fort Mojave Mesa Fire Department, Bermuda Water Company, and Citizens Utilities Rural Company, and incorporated into the evaluation of this tentative tract, and WHEREAS, the Planning Commission, by unanimous vote at the meeting on June 6, 1990 did recommend conditional approval of the preliminary subdivision plan for Tract 4107, with the following CONDITIONS noted: 1. The approval of this subdivision is based on the understanding of the Mohave County Planning and Zoning Commission that all streets within the subdivision will be constructed and paved with asphaltic concrete in accordance with Standard Specifications #171 and #101.10D of the County Engineering Road Standards or better. A water supply and distribution system including adequate pressure and volume for fire flows will be constructed to serve each lot. Grading and drainage related improvements will be made as recommended by the design engineer and approved by the county engineer. Electric and telephone service shall be provided to each lot in accordance with Arizona Corporation Commission Regulations. All lots and street centerline monuments will be staked and monumented in accordance with Standard specification #102 of the Mohave County Engineering Road Standards. Fire hydrants will be provided at locations prescribed by the Fort Mojave Mesa Fire Department, street name and regulatory signs will be installed in accordance with the requirements of the Mohave County Subdivision Regulations and as recommended by the design engineer; and, as a CONDITION OF APPROVAL, the owner/developer is responsible for the completion of improvements and shall provide an assurance for all required subdivision improvements in accordance with Article V of the Mohave County Subdivision Regulations. 2. Further Conditions of Approval are as follows: Mohave County will not accept a submission for Final Plat unless ~: it is clear that ALL comments have been addressed by the <~ij .-,'.:.:, . ~AGE 3 OF 4 BK 1749 PG 376 (FEE~90- 45086) Resolution No. 90-167 Page 3 owner/developer/engineer to the satisfaction of staff and if it appears that by addressing the conditions outlined, a substantial change in the plan is made, staff will bring it back for further review by the Commission and Board as a "Revised" Preliminary Plan as determined by the Director of Planning and Zoning. Prior to the submittal of the Final Plat the Planning Commission Staff shall assure that the items addressed by Commission staff in their recommendations presented at the Planning and Zoning hearing are accomplished. A. The required State Real Estate Report shall delineate the lots which will have common undivided interest in which specific parcels. That same data shall appear on the Final Plat map. B. Executed petition of exceptions shall be submitted for consideration by the Planning and Zoning Commission. The petitions required are: 1. Lot sizes less than six-thousand (6,000') square feet in size. 2. Eight (8') foot Public Utility Easements (PUE) along the front of the lot lines. 3. Some lot lines are neither perpendicular to street lines. radial or 4. Some lots are proposed double fronted. C. The following standard conditions are noted that apply to all submittals at this stage: 1. The developer will make the same commitments for improvements in the prospectus to the State Real state Commission as is required for approval of this tract by the Board. 2. Arizona Department of Water Resources determines that there is adequate water supply to serve this subdivision. 3. The water system will provide adequate flows for fire protection. Fire Hydrants shall be provided and located no more than eight hundred (800') feet apart and/or fire hydrants acceptable to the Fort Mojave Mesa Fire Department at the location(s) they prescribe. 5. The owner/developer shall cause the drainage related improvements to be completed as recommended by the project engineer, with changes as noted by the County Engineer/Floodplain staff and outlined in the detailed drainage report. 6. The Mohave County Planning and Zoning Commission recommends that the Board of Supervisors approve a zone change prior to recording the Final Plat. 7. The minimum lot size shall be six-thousand (6,000') square feet in area outside of the identified five-thousand (5,000') square foot lots as designated on the plat, except for corner lots which shall be a minimum of seven-thousand (7,000') square feet. D. The questions raised in the Planning and zoning letter of May 4, 1990 must be resolved to the satisfaction of the Planning Commission Staff as determined by the Director of Planning and Zoning before a submittal of a Final Plat may be accepted and processed. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July 2, 1990 approved this preliminary subdivision plan as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
