A RESOLUTION SETTING FORTH THE REZONING EIGHTY (80) ACRES IN THE
NE~ NE~ SECTION 1, TOWNSHIP 41 NORTH, RANGE 13 WEST AND THE SE~
SE~ SECTION 36, TOWNSHIP 42 NORTH, RANGE 13 WEST, FROM: A
(GENERAL) ZONE, PROPOSED TO BE: SD/C-2 (SPECIAL DEVELOPMENT
GENERAL COMMERCIAL) ZONE, LOCATED IN THE ARIZONA STRIP, MOHAVE
COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on July 2, 1990, a public hearing was
conducted to determine whether approval should be granted to
Robert M. McGarvie, dba BLACK ROCK NORTH DEVELOPMENT, St. George,
Utah for a rezoning from existing A (General) zone to SO /C-2
(Special Development/General Commercial) zone, located in the
Arizona Strip, and

this

located

approximately nineteen (19) miles northeast of Littlefield,
Arizona on 1-15 and approximately one-half (1/2) mile south of
the Utah/Arizona state line. This parcel is accessible via 1-15
and the Black Rock Interchange. The subject property is located
north of this interchange, and
WHEREAS, the applicant is requesting this rezone in order to
establish a commercial development consisting of an R. V. Park,
restaurant, riding stables, and truck stop, and

WHEREAS, a public hearing before the Mohave County Planning
and
Zoning Commission on June
6,
1990 did generate a
recommendation of approval of the zone change request with the
following conditions noted:
1. Applicant shall comply with all applicable provl.sl.ons
of Sections 25, 26, 27, & 31 of the Mohave County
Zoning Ordinances.
2. Because this project includes a proposed R.V. Park,
applicant shall comply specifically with Section 27.J
of the Mohave County Zoning Ordinances.
3. Arizona Department of Environmental Quality approves
the water supply and distribution system.
4. Due to the remoteness of the subject property, an
adequate water supply providing fire protection shall
be identified.
5. Arizona Department of Environmental Quality approved
the quantity and quality of the water supply.
6. Arizona Department of Health Services or Mohave County
Health Department approve the method of design of the
sewage systems proposed for this development.
7. All paving (roadways & parking) be paved in accordance
with Mohave County Standard Specification #171, or
better, and that such paving be completed within ninety
(90) days of the Certificate of Occupancy granted the
building.
8. Adequate parking shall be implemented in accordance
with the Mohave County Zoning Ordinance.
9. Minimum lot size shall be limited to eighty (80) acres.
10. Any open lot storage shall be screened in accordance
with Mohave County Zoning Ordinance.
11. Due to the size and complexity of this project, a
general drainage study shall be submitted to the Mohave
County Engineer for review and approval.

12. If food services are constructed, the Mohave County
Health Department grant approval of the facility under
their guidelines.
13. The owner accepts that whenever a S-D zone is granted,
each phase or stage of development or building
proposals shall be submitted to the Planning staff, to
be evaluated and compared with the approved zoning plan
before any permits may be granted.
14. Any significant change (as determined by the Planning
Director, appealable to the Planning Commission) in the
approved zoning plan shall require a rehearing on the
change before the Commission, with a final
determination to be made by the Board.
15. Staff will maintain the most current approved ZONING
PLAN on file in the master zoning folder for reviews.

16. The owner shall initiate the development of this
proposed development within two (2) years from the date
of Board approval. Prior to the expiration of the
approval, the developer may request an extension of
time from the Planning and Zoning Commission at which
time it shall be reviewed and a recommendation
submitted to the Board of Supervisors.
17. Such zone change shall not be effective for at least
thirty (30) days after final approval of the change in
zoning classification by the Board, being August 1,
1990, as per A.R.S. 11-829E.
WHEREAS, the notice of hearing was published in the Mohave
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona on June 15, 1990, and posted June 15, 1990
as required by Arizona Revised Statutes and the Mohave County
Zoning Regulations, and

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, July 2, 1990 approved this
change in zoning as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
