PAGE 1 OF 6 BOARD OF SUPERVISORS RECORDING FEE 0.00 NC RESOLUTION NO. 90-224 A RESOLUTION SETTING FORTH APPROVAL OF A FINAL SUBDIVISION PLAN FOR COURTNEY GREENS, TRACT 4054-B, A SUBDIVISION OF A PORTION OF SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, GILA & SALT RIVER BASE & MERIDIAN, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on August 20, 1990, a public hearing was conducted to determine the final subdivision plan for Courtney Greens, Tract 4054-B, located in the South Mohave Valley area, and WHEREAS,' the owner/subdivider of this tract is Counsel Corporation, Howie Torn representative. The Engineer responsible for the preparation of the drainage report, proposed method of handling storm runoff, and the design of this subdivision is Jack Stovall, P.E., Stovall Engineers, Inc., Bullhead City, Arizona, and WHEREAS, this proposed subdivision is located one-quarter (.25) of a mile east of Highway 95, is on Aztec Road, and is just west of the north/south extension of Calle Del Media, and r:;"::?; k:'.t 1-. WHEREAS, access is provided to this parcel from Highway 95 via Aztec Road, and WHEREAS, the approved preliminary subdivision plan depicts 8.6 acres subdivided into thirty (30) lots, and WHEREAS, it is intended that all lots are to be zoned R-1 (Single Family Residential) as approved by the Board on March 17, 1986 via Resolution P&ZC: 86-11, and WHEREAS, the adjoining property to the north is an approved preliminary plan, Aztec Villas, Tract 4065. To the south is Tract 4054-A and additional portions of preliminary plan of Courtney Greens, and to the west are Courtney Green Townhouses and Mohave Valley Business Park, Tract 4029, and WHEREAS, reviews have been received from the County Engineer /Floodplain Administrator, Mohave Electric Cooperative, Citizens Utilities Rural Company, Inc., the Fort Mojave Mesa Fire Department, the Mohave County Health Department, Bermuda Water Company and considered or incorporated into the evaluation of this tract, and WHEREAS, the approval of this subdivision was based on the understanding of the Commission and Board of Supervisors that the . .' PAGE 3 OF 6 BK 1779 PG 255 (FEE~90- 59797) Resolution No. 90-224 Page 3 owner/subdivider will obtain right-of-way for and pave the total right-of-way for Aztec Road to Calle Del Media, Calle Del Media south of and along this subdivision; the owner/subdivider shall agree that all streets within the subdivision will be paved with asphal tic concrete as recommended by the project engineer in accordance with County Standards or better; a water supply and distribution system will be constructed to serve each lot; the water supply and distribution system will provide for fire flows and fire hydrants conforming to the requirements of the Fort Mojave Mesa Fire Department; grading and drainage relat~d improvements will be made as recommended by the design engineer . ~ in the submitted drainage report; arrangements will be made to extend underground electric and telephone service to each lot in accordance with Arizona Corporation Commission Regulations; lot purchasers will utilize individual sewage disposal system; all lots and street centerline monuments will be staked and monumented in accordance with Standard Specification No. 102; and as a condition of approval, the owner/subdivider is responsible for the completion of these site improvements and shall provide an assurance for all required subdivision improvements in accordance with Article V of the Subdivision Regulations, and WHEREAS, this tract is within a FEMA designated floodplain, r.r;m f.?V~~ l:~~~j l.::t' Zone AO, and [D,:, .' PAGE 4 OF 6 BK 1779 PG 256 (FEEt90- 59797) Resolution No. 90-224 Page 4 WHEREAS, petitions of exception were approved with: 1) Board of Supervisors Resolution No. 90-118 for lots with double frontage, which require a non-access easement and three (3') foot block barrier and for an offset street intersection; and 2) Resolution P&ZC: 86-10 which approved blocks longer than 1320 feet, lot lines neither perpendicular or radial, eight (8') foot front lot public utility easement, and inverted streets with pavement widths less than forty (40') feet, and WHEREAS, an irrevocable Letter of Credit #01194089-70, for $201,226.55 from the Riverside National Bank, Riverside, California has been deposited with the Clerk of the Board. The bond is dated June 27, 1990 and extends to June 27, 1991 with automatic extensions to June 27, 1996, if necessary, and NOW THEREFORE BE IT RESOLVED, that the Board approved said final plan conditional to the following: 1. The developer will make the same commitments for improvements in the prospectus to the State Real Estate Commission as is required for approval of this tract by the Board. 2. The owner/subdivider shall cause the drainage related improvements to be completed as recommended by the project engineer and outlined in the detailed drainage report; a grading plan shall be provided as a part of the improvement plans for this subdivision. 3. The Board of Supervisors approves the zone change as delineated in Resolution P&ZC: 86-11 and that this zoning be in effect thirty (30) days after the recording of the final plat. ~~.~<;,; ;.".....v.'.'.J, ~~~::,'::~;'! The final plat will include public utility easements at the front of the lots and/or as necessary to serve these lots with underground utilities. 5. The minimum lot size shall be 8,000 square feet in area. 6. The proposed access road, Aztec Road, shall be dedicated and paved through Mohave Valley Business Park, Tract 4029 prior to or simultaneously with the recording of this final subdivision plan. 7. A full width right-of-way shall be obtained for Aztec Road and included on the plat to be recorded. 8. The owner/subdivider shall obtain a report from the Arizona Department of Water Resources indicating that the water supply has been found to be adequate to meet the needs of this subdivision prior to recording the final plat. 9. The owner/subdivider shall obtain a report from the Arizona Department of Environmental Quality regarding the condition of installation of septic tanks. 10. The final plat for Tract 4054-B including !-h~ dedication will ne~d to be properly executed and/or ratified Qy all parties having any record title interest in the land being subdivided and included within this subdIViSIOn boundary. 11. An original copy of the CC&R's, signed and notarized, be provided for recording. 12. Actions be initiated and finalized for obtaining the necessary right-of-way for Aztec Road within the W~ SE~ NW~ Section 23, Township 19 North, Range 22 West and it shall be included on the final plat as required by the preliminary plan approval. The owner/subdivider shall assure abandonment procedures are presented to the Board of Supervisors to abandon the remainder of a roadway easement along the south boundary of the above described parcel. 13. There are fifteen (15) concerns that were addressed by the County Engineer in his review of August 16, 1990 that will require corrections to the Final Plat prior to recordation. The reviewing departments and the Director of Planning and Zoning shall assure that each is addressed adequately before presenting the Final Plat to the Chairman for signature. NOW THEREFORE BE IT FURTHER RESOLVED, upon receipt of or evidence that these conditions have been met together with the executed mylars and appropriate recording fees, the Director of Planning and Zoning will obtain the necessary signatures from the County Departments and officials and cause the final plat to be recorded, and NOW THEREFORE BE IT FURTHER RESOLVED, that notice of hearing has been met and published throughout this subdivision process and the public was afforded notice of this final action through advertisement of the Board of Supervisor's meeting for this date.
