PAGE 1 OF 6 BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 90-217 A RESOLUTION SETTING FORTH APPROVAL OF A FINAL SUBDIVISION PLAN FOR SILVER SANDS ESTATES, TRACT 4080, A SUBDIVISION OF A PORTION OF THE NE~ SECTION 26, TOWNSHIP 19 NORTH, RANGE 22 WEST, GILA & SALT RIVER BASE & MERIDIAN, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 20, 1990, a public hearing was conducted to determine the final subdivision plan for Silver Sands Estates, Tract 4080, located in the South Mohave Valley area, and WHEREAS, the owner/subdivider of this tract is Silver Sands Estates, limited partnership, Anthony Gartshore, a representative. The Engineer responsible for the preparation of the drainage report, proposed method of handling storm runoff, and the design of this subdivision is Stuart Powell, P.E., South Pointe Consultants, Bullhead City, Arizona, and WHEREAS, this proposed subdivision is located three-quarters (.75) of a mile east of Highway 95, is between Hammer Lane and EI Rodeo Road, and is just east of the north/south extension of Calle Del Media. This roughly forty-seven (47) acre parcel fronts on both Hammer Lane and EI Rodeo Road, and M. . :'.!:: ."....t ...'..."...'.. ?~","~ ::,{'j . WHEREAS, access is provided to this parcel from Highway 95 via EI Rodeo Road or Hammer Lane, and WHEREAS, the submitted preliminary subdivision plan depicts forty-seven (47) acres subdivided into 159 lots, and WHEREAS, it is intended that all lots are to be zoned R-O (Single Family Residential/Mobile Homes Prohibited) as approved by the Board on November 1, 1988 via Resolution P&ZC: 88-177, and WHEREAS, the adjoining property to the north is an older W: ::::: v i:fiO:a:e:neLa~:) ::r:o~:ts ~o:::e v~::: R::::::~, T:::: i:::: ~ divided into five (5) acre parcels but parcelled into smaller units. The property to the west is unsubdivided and to the east it abuts onto acre lots of Las Estancias, Tract 1199, and WHEREAS, reviews have been received from the County Engineer/Floodplain Administrator, Citizens Utilities Rural Company, Inc., the Fort Mojave Mesa Fire Department, the Mohave County Health Department, Bermuda Water Company and incorporated into the evaluation of this tract, and ~~ WHEREAS, the approval of this subdivision was based on the Ct understanding of the Commission and the Board of Supervisors that ~"':1 :~;:;j ~'(}\i ,(.,::.u. '-"" .....~J t.'T.'.:;>' :;~Ii ~;;":\':~:": \""," .':'".~::f ~.'..'.."\....'...t.'. ,<;/ \",'>:" !, I_;,~ ',..1. t::',,':',' . ~E 3 OF 6 BK 1779 PG 243 (FEEt90- 59795) Resolution No. 90-217 Page 3 the owner/subdivider will obtain right-of-way for and pave the frontage road, Hammer Lane from three hundred (300') feet east of Calle Del Media south of and along this subdivision; the owner/subdivider shall agree that all streets within the subdivision will be paved with asphaltic concrete, including curb and gutter as shown on the improvement plans, as recommended by the project engineer in accordance with County Standards or better; a water supply and distribution system will be constructed to serve each lot; the water supply and distribution system will provide for fire flows and fire hydrants conforming to the requirements of the Fort Mojave Mesa Fire Department; grading and drainage related improvements will be made as recommended by the design engineer in the submitted drainage report; arrangements will be made to extend underground electric and telephone service to each lot in accordance with Arizona Corporation Commission Regulations; lot purchasers will utilize individual sewage disposal system; all lots and street centerline monuments will be staked and monumented in accordance with Standard Specification No. 102; and as a condition of approval, the owner/subdivider is responsible for the completion of these site improvements and shall provide an assurance for all required subdivision improvements in accordance with Article V of the Subdivision Regulations, and G.....,....:......'.'. ~.; l~ ",";' l"-' I' "'1 ,,:> ,~ ,..., 0"0 r:,.~../,,: t~,,{i f~ ~\.' PAGE ~ OF 6 BK 1779 PG 2~4 (FEEt90- 59795) Page 4 Resolution No. 90-217 WHEREAS, a petition of exception was approved with Resolution P&ZC: 88-176 for lots with double frontage, which require a non-access easement and barrier; for lot lines that are nei ther radial or perpendicular to the street lines; interior streets are to have inverted crowns; eight (8') foot public utility easements will be placed at the front of each lot instead of back lot line easements; a thirty (30') foot right-of-way for the extension of Calle Del Media will be dedicated but not constructed; and some blocks are greater than the maximum allowable block length, and WHEREAS, a performance bond covering labor and materials for $670,000, Bond #4301, from Pacific States Casualty Company has been deposited with the Clerk of the Board. The bond is dated March 15, 1990 and was referred to the Mohave County Attorney for review, and NOW THEREFORE BE IT RESOLVED, that the Board approved said final plan conditional to the following: 1. The developer will make the same commitments for improvements in the prospectus to the State Real Estate Commission as is required for approval of this tract by the Board of Supervisors. The owner/subdivider shall cause the drainage related improvements to be completed as recommended by the project engineer and outlined in the detailed drainage report; a grading plan shall be provided as a part of the improvement plans for this subdivision. 2 . The Board of Supervisors approves the zone change as delineated in Resolution P&ZC: 88-177 and that this zoning be in effect thirty (30) days after the recording of the final plat. 4. The final plat will include public utility easements at the front of the lots and/or as necessary to serve these lots with underground utilities. 5. The minimum lot size shall be 8,000 square feet in area. 6. The I-inal plat for Tract 4080 including the !?e<!i,~ati~n will need to be properly executed and/or ratified ~ all parties having any record title interest in the land being subdivided and included within this subdivision boundary. 7 . The project engineer shall revise the final plat to include the elevation datum basis and !he description of the sUbSurface centerline monuments prior to record- recordation in accordance with Mohave- County Subdivision R€!gulations and Standard Engineering Specifications. B. The owner/subdivider shall obtain a report from the Arizona Department of Environmental Quality regarding the conditions of installation of septic tanks. 9. A complete list of all improvements and their costs shall be submitted for approval by the County Engineer as per his request and the Engineer confirming the amount of bond necessary to assure completion of all improvements as the face of the bond states only items listed in the agreement are covered. NOW THEREFORE BE IT FURTHER RESOLVED, upon receipt of or evidence that these conditions have been met together with the executed mylars and appropriate recording fees, the Director of Planning and Zoning will obtain the necessary signatures from the County Departments and officials and cause the final plat to be recorded, and · .. . fL> . .
