A RESOLUTION SETTING FORTH APPROVAL OF A FINAL SUBDIVISION PLAN
FOR EMERALD RIVER ESTATES, TRACT 4093-A, A SUBDIVISION OF A
PORTION OF THE SW% SECTION 24 AND NW% SECTION 25, TOWNSHIP 19
NORTH, RANGE 22 WEST, GILA & SALT RIVER BASE & MERIDIAN, LOCATED
IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on August 20, 1990, a public hearing was
conducted to determine the final subdivision plan for Emerald
River Estates, Tract 4093-A, located in the South Mohave Valley
area, and

WHEREAS, owner/subdivider of this tract is Emerald River
Development, Doug Cain, representative. The Engineer responsible
for the preparation of the drainage report, proposed method of
handling storm runoff, and the design of this subdivision is
Raymond W. Stadler, P.E., and
WHEREAS, this proposed subdivision is located east of
Highway 95, on EI Rodeo Road, one-quarter (.25) mile east of
Mountain View Road, and
WHEREAS, access is provided to this parcel from Highway 95
f0B via El Rodeo Road. This site abuts El Rodeo Road, and

WHEREAS, the submitted preliminary subdivision plan depicts
thirty-two (32) acres subdivided into 107 lots. This unit, Tract
4093-A, is twelve (12) acres and forty-five (45) lots, and
WHEREAS, it is intended that all lots are to be zoned R-O
(Single Family ReSidential/Mobile Homes Prohibited) as approved
by the Board on March 5, 1990, via Resolution No. 90-59, and
WHEREAS, the adjoining property to the north is unsubdivided
State of Arizona land.
Directly east lies the approved
preliminary plan for Mission Park Ranch, Tract 4072. South lies
proposed preliminary plat of Sage Estates, and
WHEREAS, it is intended than an existing easement along the
north boundary is to be extinguished prior to recording the final
subdivision plat, and
WHEREAS,
reviews have been received from the County
Engineer/Floodplain Administrator,
Citizens
Utilities
Rural
Company, Inc., the Fort Mojave Mesa Fire Department, the Mohave
County Health Department,
and Bermuda Water Company and
considered or incorporated into the evaluation of this tract, and
Jt~ WHEREAS, the approval of this subdivision was based on the
CL" understanding of the Commission and the Board of Supervisors that

the owner/subdivider will obtain right-of-way for and pave the
access road, Emerald River Drive from EI Rodeo Road south to this
subdivision; the owner/subdivider shall agree that all streets
within the subdivision will be paved with asphaltic concrete,
including curb and gutter as shown on the paving plans, as
recommended by the Project Engineer in accordance with County
Standards or better; a water supply and distribution system will
be constructed to serve each lot; the water supply and
distribution system will provide for fire flows and fire hydrants
conforming to the requirements of the Fort Mojave Mesa Fire
Department; grading and drainage related improvements will be
made as recommended by the design engineer in the submitted
drainage report; arrangements will be made to extend underground
electric and telephone service to each lot in accordance with
Arizona Corporation Commission Regulations; lot purchasers will
utilize individual sewage disposal system; all lots and street
centerline monuments will be staked and monumented in accordance
with Standard Specification No. 102; and as a condition of
approval, the owner/subdivider attests that all of the required
site improvements have been completed in accordance with Article
v of the Subdivision Regulations, and
WHEREAS, a few lots of this tract are within a FEMA
designated floodplain, Zone B, and

WHEREAS, the Commission and Board considered and approved
the drainage plan as submitted by the project engineer and as
evaluated by the County Engineer, and
WHEREAS, a petition of exception was approved for eight (8')
foot front lot public utility easements in lieu of sixteen (16')
foot rear lot line easements and for blocks longer than 1320 feet
by Resolution No. 90-190, and
NOW THEREFORE BE IT RESOLVED, that the Board approved the
said final plan conditional to the following:

improvements to be completed as recommended by the
project engineer and outlined in the detailed drainage
report; a grading plan shall be provided as a part of
the improvement plans for this subdivision.
3. The minimum lot size shall be 9,600 square feet in
area.
4. The final plat for Tract 4093-A includiB..g the
Dedication will need to be properly executed ang,/or
ratified Qy all parties having any record title
interest in the land being subdivided and included
within this subdivision boundary.

5. The owner/subdivider shall obtain a report from
Arizona Department of Environmental Quality regarding
the requirements for individual sewage disposal
systems prior to the recording of this subdivision.
6. The report to the State Real Estate Department shall
include the statements from the Arizona Department of
Water Resources and the Arizona Department of
Environmental Quality. Corrections to this report
should include, under Item 17, that fire protection is
from Fort Mojave Mesa Fire District, not Mohave
County; and that there is a private landing strip
three-quarters (.75) mile away, not an airport.
7. Parcel B, a segment of access road between El Rodeo
Road and the north sectionline, is a right-of-way and
landscape easement granted by the State Land
Department to the developer. The easement shall be
assigned to Mohave County by the developer and the
developer agrees to maintain the landscape features,
and hold the County harmless to same.

The County Engineer shall approve the improvement cost
estimates, improvements plans, as-builts, as the
approval of these actual improvements are within his
jurisdiction to evaluate. These shall be accomplished
prior to recordation of the final plat as the
assurances are dependent upon such approvals.
10. In reference to the provision made in the CC&R's for
perpetual maintenance of Parcel B. In order to assure
this, it will be necessary to incorporate the property
owner's group.
NOW THEREFORE BE IT FURTHER RESOLVED, upon receipt of or
evidence that these conditions have been met together with the
executed mylars and appropriate recording fees, the Director of
Planning and Zoning will obtain the necessary signatures from the
County Departments and officials and cause the final plat to be

NOW THEREFORE BE IT FURTHER RESOLVED, that notice of hearing
has been met and published throughout this subdivision process
and the public was afforded notice of this final action through
advertisement of the Board of Supervisor's meeting for this date.
