PAGE 1 OF 2 BOS RECORDING FEE 0.00 Ne -e RESOLUTION NO. 90-190 RESOLUTION SETTING FORTH APPROVAL OF A PETITION OF EXCEPTION FOR EMERALD RIVER ESTATES, TRACT 4093, A SUBDIVISION OF PORTIONS OF THE N~ OF THE NW~ SECTION 25, AND THE SW~ SECTION 24, TOWNSHIP 19 NORTH, RANGE 22 WEST LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave COUll ty Board of Supervisors held on August 6, 1990, a public hearing was conducted to determine the approval of the Petition of Exception, and f~.::<::t r.S";J .,.....;,.~ ;~t~ ,-. ~ -.~ ..........~_....... WHEREAS, the owner/developer of this tract is Doug Cain, Bullhead City, Arizona. The Engineer responsible for the preparation of the drainage report and design of this subdivision is Raymond W. Stadler, P.E., Stadler Allen & Associates, Bullhead City, Arizona, and WHEREAS, the Commission at their meeting on July 18, 1990 did recommend conditional approval of the Petition of Exception for Tract 4093 as follows: 1. The development is proposing eight ( 8 ') foot Public Utility Easements (PUE's) along the fronts and sides of all lots adjacent to the street rights-of-way. Section 6.9-1 of the Subdivision Regulations requires a minimum of sixteen (16') foot wide PUE be provided along the rear lot lines. .,- i:;t:.;1 I~~~:~ 'cd 2. The block containing Lots 82-107 is longer than the 1,320 feet allowed in Section 6.6-1A of the Subdivision Regulations. . , '" "'Resolution No. 90-to ~ ~"':;:.:.1ol1Wll..'- . Page 2 This petition is submitted as a request that the Planning and Zoning Commission recommend to the Board of Supervisors the granting of an exception from the Subdivision Regulations as outlined in Article 1.13 for the following reasons: 1. The granting of this petition will not be detrimental to the public welfare or injurious to other adjacent properties because the proposed Emerald River Estates lot configuration does not restrict usage or access to those adjacent properties. Furthermore, the elongated block will have access from both ends 'which will facilitate use by emergency vehicles and provide for traffic circulation. 2. This request will not nullify the intent or purpose of the Master Plan of the County or other regulations because the proposed exception does not change the intended land use, nor does it impact adjacent properties in such a way as to limit their use. 3. The special circumstances or conditions affecting said property are as follows: :.JI~~~ [;~ ~'~ :~~ a. Access through the elongated block, made up of Lots 82-107 of Emerald River Estates, was not possible due to lack of access through State Land to the north and the previously approved configuration of the Mission Park Subdivision to the east. b. The electric, telephone, gas, and CATV utili ties serving the Emerald River Estates subdivision will all be underground. Therefore having these utilities located along the fronts of the lots and adjacent to the street rights-of-way, will allow for easier system maintenance. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 6, 1990 approved this Petition of Exception as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
