RESOLUTION NO. 90-262 A RESOLUTION SETTING FORTH THE REZONING OF THE SW~ SECTION 18, TOWNSHIP 19 NORTH, RANGE 21 WEST, TO BE KNOWN AND SUBDIVIDED AS SUNRISE VISTAS, TRACT 4108, FROM: RE/10A (RESIDENTIAL RECREATION/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: SD/R- 1/6M (SPECIAL DEVELOPMENT/SINGLE FAMILY RESIDENTIAL/SIX THOUSAND SQUARE FEET MINIMUM LOT SIZE) ZONE, SD/C (SPECIAL DEVELOPMENT/COMMERCIAL), AND SD/M (SPECIAL DEVELOPMENT/MANUFACTURING) ZONES, SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 1, 1990, a public hearing was ::.~ I~ .::.-".; r~;!! conducted to determine whether approval should be granted to: l.r:~ fl~1 liD Vanderslice 80, Sherman Oaks, California; B & R Development, an Arizona corporation, Fort Mojave, Arizona; and Alexander/Catania Development, Inc., a California corporation, Azusa, California, for a rezoning from existing R-E/10A (Residential Recreation/Ten Acre Minimum Size) SD/R-1/6M (Special Lot zone to Development/Single Family Residential/Six Thousand Square Foot Minimum Lot Size), SD/C (Special Development/Commercial), and SD/M (Special Development/Manufacturing) zones, located in the South Mohave Valley area, and WHEREAS, Sunrise Vistas, Tract 4108, is located one (1) mile south of Bullhead City and approximately two (2) miles east of Highway 95. This subdivision will consist of 155 acres of SD/R- ( .. . . Resolution No. 90-262 Page 2 1/6M and 2.21 acres of SD/C-2 zoning. Preliminary plans indicate a creation of 704 residential lots resulting in a density of 4.25 dwelling units per acre. There is a 2.37 acre parcel potentially dedicated for a sewage treatment plant. This parcel will be zoned SD/"M", however, if treatment can be handled off-site, the 2.37 acres will become commercial, creating a total SD/C-2 acreage of 4.58 acres. Surrounding land uses consist of platted subdivisions to the west and State land on the remaining sides. This change would be in violation of the Mohave County Zoning Regulations due to some lot designs, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on September 12, 1990 did generate a recommendation of approval of the zone change request with the following conditions noted: 1. Mohave County Subdivision Regulations require that lots designed for mobile homes be at least one-hundred (100') feet in depth (Article 6.7-6B MCSR) with standard R-1 zoning. Many of the lots in this subdivision do not meet the mlnlmum 100' depth, however, due to lot design, they could meet usage under SD. 2. Parcel "C" identified as commercial shall be designated as "SD-C". 3. The parcel set aside for the sewer treatment plant shall be designated as "SD-M", however, should there be an agreement that would move the sewerage facility off site, the "SD-M" designation shall revert to "SD-C". 4. Compliance with the conditions Preliminary Plat approval. stated on the ..:~:::~, ~,~~.. \~1 >~""'~t~ :,,-' 5. Any significant change (as determined by the Planning Director - appealable to the Planning Commission, in the approved zoning plan shall require a rehearing on the change before the Commission, with a final determination to be made by the Board. 7. The use of this property may not be changed by the owner/developer or subsequent owners as it is approved unless subsequently approved by the Board in accordance with Arizona Statutes Annotated, Title II, Chapter 6, Section 11-832. 8. The rezone shall become effective upon the recordation of the Final Plat. WHEREAS, the notice of hearing was published in the Mohave Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on August 24, 1990, and posted August 29, ~~ ~~~ 0'="~ ?r~ 1990 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 1, 1990 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
