PAGE 1 OF 7 80S RECORDIHG FEE 0.00 He RESOLUTION NO. 90-251 A RESOLUTION SETTING FORTH THE ABANDONMENT OF A CERTAIN RECORDED ROAD RIGHT-OF-WAY AND OF CERTAIN PLATTED LOTS AND EASEMENTS IN DESERT LAKES GOLF COURSE AND ESTATES, TRACT 4076-B, IN THE SOUTHEAST ONE-QUARTER OF SECTION 35, TOWNSHIP 19 NORTH, RANGE 22 WEST OF THE GILA AND SALT RIVER BASE AND MERIDIAN, NEAR THE INTERSECTION OF MOUNTAINVIEW ROAD AND LIPAN BOULEVARD, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on September 17, 1990, a public hearing was conducted to determine the abandonment request from the T ~:~~.",j~, [. :.~,. (~~ applicant, Westitle Corporation, as trustee for Desert Lakes Development, L. P., owners of the property involved or directly adjacent to the requested abandonment, and WHEREAS, Mr. William E. Miller, with Holland West, Inc. will represent the petitioners in the Road, Lots and Easements Vacation request, and WHEREAS, the requested abandonments are a part of the property platted by Desert Lakes Golf Course and Estates, Tract 4076-B, recorded December 18, 1989 at Fee No. 89-67669, and ~~;) ~.;':~ WHEREAS, new right-of-way, lots and easements were set r~ ~ forth on the proposed plat of Desert Lakes Golf Course and . ~ ..,'>'.....'.!.~~_4".~ --:'.< '~- - .. " cj . .E 2 Of' 7 BK 1793 PG 29~ (FEE~90- 66570) Page 2 Resolution No. 90-251 Estates, Tract 4076-D, and WHEREAS , the portions to be abandoned and reverted to acreage are a portion of Parcel K-K, and the cul-de-sac Mountain View Court, and the Lots 75-86, Block F of Desert Lakes, Tract 4076-B. The eight (8') foot public utility easement along the front of said Lots 76-86, the one (1') foot vehicular non-access easement on Lots 75-86, Block F, Tract 4076-B and the drainage, public utility rights in ingress/egress easements on Parcel K-K involve with these new lots shall be vacated or extinguished within the Desert Lakes Golf Course and Estates Tract 4076-B, located in the southeast one-quarter of Section 35, Township 19 North, Range 22 West, located in the South Mohave Valley area, and WHEREAS , the petitions submitted are requesting the abandonment of certain dedicated recorded road right-of-way and plotted lots and easements as follows: LEGAL DESCRIPTION FOR THE PORTION OF PARCEL K-K TO BE VACATED AND REVERTED Portions of Parcel K-K of Desert Lakes Golf Course and Estates Tract 4076-D as shown on the plat recorded at Fee No. 89-67669, Mohave County Records, and located in the Southeast one-quarter of the Southeast one-quarter of Section 35, Township 19 North, Range 22 West of the Gila and Salt River Base and Meridian, Mohave County, Arizona, more particularly described as follows: Beginning at the Northwest corner of Lot 86 Block F of said Tract 4076-B; Thence S89:56'Ol"E along the North lines of Lots 86 through 83 of said Block F a distance of 240.00 feet; '"'. .';;';-'",.'.> .~.,. ;,.'~'. LEGAL DESCRIPTION FOR THE SUBDIVISION LOTS TO BE ABANDONED AND REVERTED Lots 75 through 86 of Block F of Desert Lakes Golf Course and Estates, Tract 4076-B as shown on the plat recorded at Fee No. 89-67669, Mohave County Records, and located in the Southeast one-quarter of the Southeast one-quarter of Section 35, Township 19 North, Range 22 West, of the Gila and Salt River Base and Meridian, Mohave County, Arizona; Containing 80,123 square feet or 1.8394 acres, more or less. WHEREAS , these abandonments were initiated by the applicants because they are no longer needed by the public, they were anticipated by the proposed plat of Desert Lakes Golf Course and Estates, Tract 4076-D, and they affect no other citizens except the applicants, and WHEREAS, in evaluating this abandonment request the County Engineering Department has recommended that the above referenced right-of-way lots and easements be abandoned, and WHEREAS, information available to this Board indicates that this abandonment will leave no adjoining or affected properties without legal or physical access, or result in the extinguishment of a useful roadway, and WHEREAS, no utilities are located within the subject right- of-way and easements, and PAGE 6 OF 7 BK 1793 P6 298 (FEEt90- 66570) . . (~ , :1 i,j o"-'7>1! ,.,,:;-, Resolution No. 90-251 Page 7 WHEREAS, the notice for public hearing before the Board of Supervisors was posted at the Board of Supervisor's office, Mohave County Court House, and Public Defender's office on September 14, 1990 as required by Arizona Revised Statutes and the Mohave County Zoning Ordinance, and WHEREAS, title to the abandoned road right-of-ways and easements shall vest in the owner(s) of land abutting the vacated roadway in accordance with A.R.S. 28-1902, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors ~ ~ ~~ -.-~ hereby abandon the dedicated recorded road right-of-way and the easements as herein described in the legal descriptions, and NOW THEREFORE BE IT FURTHER RESOLVED, that the Board of Supervisors hereby adopts this Resolution No. 90-251 and instructs the Clerk to record this Resolution with the County Recorder.
