PAGE 1 OF 5 BOS RECORDING FEE 0.00 He RESOLUTION NO. 90-248 A RESOLUTION SETTING FORTH APPROVAL OF A FINAL SUBDIVISION PLAN FOR DESERT LAKES IV, TRACT 4076-D, A SUBDIVISION OF A PORTION OF SECTION 35, TOWNSHIP 19 NORTH, RANGE 22 WEST, ALSO BEING THE RESUBDIVISION OF LOTS 75-86, BLOCK F, AND A PORTION OF PARCEL K- K, DESERT LAKES, TRACT 4076-B, MOHAVE COUNTY, ARIZONA WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on September 17,1990, a public hearing was conducted to determine the final subdivision plan for Desert Lakes Estates, Tract 4076-D, located in the South Mohave Valley r~~ area, and \':'-'." ,;;fJtrl ;'".;-..)j it1:J WHEREAS, reviews have been received from the County Engineer/Floodplain Administrator, Mohave County Health Department, Arizona Department of Environmental Quality, Bermuda Water Company, Inc. , Sorenson Utilities, Mohave Electric Cooperative, Mohave County Attorney, Mohave County Treasurer, Fort Mojave Mesa Fire District, and considered or incorporated in the evaluation of this final tract, and WHEREAS, the owner/developer of this tract is Desert Lakes Development, L.P., a Delaware Limited Partnership, and ~ ,iliJ WHEREAS , the engineering firm responsible for the preparation of the design of this subdivision is Holland west of --,., ". : r;~f~.;1 1,,,,.>,; ~ '-.- t~~~~] :f~ ;\~ :. -~,:;"t l~ " . tE 2 OF 5 K 1793 P6 278 (FEE~90- 66567) Resolution No. 90-248 Page 2 Denver, Colorado, with offices in Bullhead City, Arizona, and WHEREAS, the new tract is within the existing recorded subdivision of Desert Lakes, Tracts 4076-B and 4076-C, and is of identical uses as there these tracts, and WHEREAS, the Commission at their meeting on August 8, 1990 did recommend conditional approval of the preliminary subdivision plan for Tract 4076-D with the following conditions noted: A. Desert Lakes, Tract 4076-D, a subdivision of 2.32 acres proposed to be divided into twelve (12) residential lots is already zoned as Special Development (SD) district. B. Petitions of exception were submitted for the following exceptions to the Mohave County Subdivision Regulations: 1. C. The subdivision is designed for sewage disposal through a functioning sewage disposal plant which serves all of Desert Lakes lots. The facility is operated by Sorenson Utilities or attachment to the Fort Mojave Tribal Utilities Authority. D. The preliminary approval of this tract is based on the understanding of the Commission that the primary access to this subdivision is Lipan Boulevard and Mountain View Road. The direct access to the lots is from a frontage road separated from the section line arterials by a tinted patterned concrete median constructed by the developer. This project is within the Mohave Valley Irrigation and Drainage District. E. The following documents are on file: 1. Statement of approval to construct sewer lines from ADEQ. 2. Approval to construct water service and adequacy of supply. 3. The following actions of abandonment, reversion to acreage, vacation or extinguishment have been approved: a. That portion of Parcel K-K, included in the Tract 4076-D, b. The drainage, public utility rights, and ingress/egress easements on Parcel K-K involved with these new lots, c. The Lots 75-86, Block F of Desert Lakes, Tract 4076-B, d. The eight (8') foot public utility easement along the front of said Lots 75-86, Block F, e. The cul-de-sac, Mountain View Court, f. The following standard conditions are noted that apply to all submittals at this stage: 1. The developer will make the same commitments for improvements in the prospectus to the State Real Estate Commission as is required for approval of this tract by the Board of Supervisors. 2. An updated policy of title insurance shall be provided. 3. The water system will provide adequate flows for fire protection. The water supply system is in place, approved with the, recording of Tract 4076-B. 4. A document of assurances for construction of improvements shall be submitted and approved. 5. The minimum lot size shall be 6,000 square feet in area. 6. Draft of the Covenants, Restrictions must be submitted. Conditions and G. The approval of this subdivision is based on the understanding of the Mohave County Planning and Zoning Commission that all streets within the subdivision will be constructed and paved with asphaltic concrete and shall include curb and gutter, in accordance with Standard Specifications #171 and #101.10D of the County Engineering Road Standards or better. A water supply and distribution system including adequate pressure and volume for fire flows will be constructed to serve each lot. Grading and drainage related improvements will be made as recommended by the design engineer. Electric and telephone service shall be provided to each lot in accordance with Arizona Corporation Commission Regulations. All lots and street centerLine monuments will be staked and monumented in accordance with Standard Specification No. 102 of the County Engineering Road Standards. Fire hydrants will be provided at locations prescribed by the Fort Mojave Mesa Fire Department. Street name and regulatory signs will be installed in accordance with the requirements of the Mohave County Subdivision Regulations and as approved by the Planning Commission staff; and, as a condition of approval, the owner/subdivider is responsible for the completion of improvements and shall provide an assurance for all required subdivision improvements in accordance with Article V of the Mohave. County Subdivision Regulations. ("<' . '< ' <, Resolution No. 90"-A8 Page 5 NOW THEREFORE BE .IT RESOLVED, that the Board approves the said final plan conditioned to the following: 1. The developer will make the same commitment:s for improvements in the prospectus to the State Real Estate Commission as is required for approval of this tract by the Board; 2.
