A RESOLUTION CONSIDERING THE REZONING OF LOT 14, FORT MOHAVE MESA
RANCHOS, FROM: A-R (AGRICULTURAL-RESIDENTIAL) ZONE, PROPOSED TO
BE: R-M (MULTIPLE FAMILY RESIDENTIAL) ZONE, TAKING INTO
CONSIDERATION PROTESTS OF TWENTY (20%) PERCENT BY AREA AND NUMBER
OF SURROUNDING PROPERTY OWNERS, LOCATED IN THE SOUTH MOHAVE
VALLEY AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on September 4, 1990, a public hearing was
conducted to determine whether approval should be granted to
Mildred Tacey, Vista, California for a rezone from existing A-R
(Agricultural-Residential)
to
R-M
(Multiple
Family
zone,
Residential) zone, and
WHEREAS, a public hearing before the Mohave County Planning
and zoning Commission on November 8, 1989 did generate a
recommendation of approval of this request with the following
condition noted:
1. The applicant comply with all applicable provlslons of
Section 25, 26, 27, and 31 of the Mohave County Zoning
Regulations.
2. That the erection of a fence be completed wi thin one
(1) year of the approval of the zoning by the Board of
Supervisors.
3.
Arizona Department of Environmental Quality approves
the sewage facility and sewer treatment system for this
project.

The water system will provide adequate flows for fire
protection. F ire hydrants conforming to the minimum
County standards shall be provided and located no more
than acceptable to the Fort Mojave Mesa Fire Department
at the location they prescribe.
5. Arrangements will be made to extend underground
electric and telephone service to each building
footprint in accordance with Arizona Corporation
Commission Regulations.
6. Arizona Department of Water Resources determines that
there is an adequate water supply to serve this
project.
7. Arizona Department of Environmental Quality approves
the water supply and distribution system.

That the applicant mail by first class postage the
change of zoning notice to all property owners of
record within 300 feet of the property proposed to be
rezoned. That this be accomplished by the owner
delivering to the Planning and Zoning office such
mailings with the appropriate postage affixed so that
the notice of mailing will be duly noted in the
applicants file or provide the Planning and zoning
Department with a notarized statement that the mailing
has been accomplished. This notice of mailing or
statement must be in the office of Planning and zoning
a minimum of fourteen (14) calendar days before the
Board acts upon the request. This is to assure
surrounding property owners are properly notified of
the proposed change so they may speak to the change if
they desire. The signatures of 51% is not a
requirement unless desired by the applicant.

WHEREAS, this approximate 4.81 acre parcel has access from
Highway 95 via either Joy Lane or Wagon Wheel Lane to Calle Valle
Vista. The properties adjacent and behind this parcel are zoned
SD/C-2, C-2, and M respectively.

The applicant represents that they plan to
develop an approved sewerage treatment facility on site to handle
the sewerage for this proposed apartment facility. The applicant
feels that this development is not inconsistent with other area
development and it would act as a buffer to the highway
development adjacent to this parcel, and
WHEREAS, the applicant complied with Condition #8 above in
August, 1990, and
WHEREAS, the notice of hearing was published in the Mohave
Daily Miner, a newspaper of general circulation in Kingman,

Mohave County, Arizona on November 15, 1989, and posted on
November 14, 1989 as required by the Arizona Revised Statutes and
the Mohave County Zoning Regulations, and
WHEREAS, protests have been made by property owners within
the three hundred (300') foot radius.
These protestors consist
of more than twenty (20%) percent in number and area, and in
accordance with A.R.S. 11-829C, "but if twenty (20%) percent of
the owners of property by area and number within the zoning area
file a protest to the proposal change, the change shall not be
made except by the unanimous vote of all members of the Board."
The Board must vote unanimously for approval of this item and if

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Tuesday, September 4, 1989, by a vote
of 5*' of 5', ~he~ (denied) this change in zoning as
recommended by the Mohave County Planning and Zoning Commission,
as outlined herein.
