A RESOLUTION SETTING FORTH THE REZONING OF LOTS 36 AND 37,
GATEWAY ACRES f11, SECTION 5, TOWNSHIP 24 NORTH, RANGE 19 WEST,
FROM: A-R/5A (AGRICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT
SIZE) ZONE, PROPOSED TO BE: M (GENERAL MANUFACTURING) ZONE,
LOCATED IN THE DOLAN SPRINGS AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on September 4, 1990, a public hearing was
conducted to determine whether approval should be granted to
Woodrow Widdle, Dolan Springs, Arizona, for a rezoning from

existing A-R/5A (Agricultural-Residential/Five Acre Minimum Lot
Size) zone to M (General Manufacturing) zone under Category 9 of
Section 32, Mohave County Zoning Regulations, for the specific
purpose of manufacturing fiber glass pools/containers, located in
the Dolan Springs area, and
WHEREAS, Gateway Acres #11 is located approximately three
(3) miles south of the Highway 93/Pierce Ferry Road junction.
The subject property has frontage on Highway 93 and approximately

WHEREAS, this area is not included in the Dolan Springs Area

parcels is BLM land.
Other surrounding land is vacant at this
time. The applicant wishes to manufacture fiberglass swimming
pools. As manufacturing activity with fiberglass is not allowed
in a C-MO (Commercial Manufacturing/Open Lot Storage) zone, a
modification of the original request was made and approved by the
applicant.
The request is now for a M (General Manufacturing)
zone.
The applicant has stated his access will be off of
Cottonwood Lane until planned improvements to Highway 93 are made
and at that time he will access off of Highway 93, and
WHEREAS, a public hearing before the Mohave County Planning
and Zoning Commission on August 8, 1990 did generate a
recommendation of approval of the zone change request, under
Category 9 of Section 32, Mohave County Zoning Regulations, for
the
specific
of
manufacturing

purpose
pools/containers, with the following conditions noted:
1. The applicant comply with all applicable provisions of
Sections 23, 25, 26, 27, and 31 of the Mohave County
Zoning Regulations.
2. This zone change shall be effective for Lot 37 o.nly.
Thus, the Planning and Zoning Commission is
recommending approval of a ~A (General
Manufacturing/Four acre minimum lot size) zone.

The parcels created from Highway 93 bisecting L.Q.:!:.... 36
shall be designated A-R (agricultural-residential) w}1b
the minimum lot size to be determined by the recorded
parcel plat, one (1) parcel each side of the highway
right-of-way.
4.
Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.

5. All FEMA Flood Zone locations as well as any other
surface drainage shall be indicated on the Parcel Plat.
6. The establishment of minimum lot area based on the size
of the parcels per the recorded Final Plat. This plat
should indicate any impacts on the parcel area affected
by Highway 93 improvements.
7. Any change (as determined by the Planning Director -
appealable to the Planning Commission) in the approved
specific land use shall require a rehearing on the
change before the Commission, with a final
determination to be made by the Board in accordance
with Section 23 of the Mohave County Zoning
Regulations.
8. Arizona Department of Water Resources approves the
water supply and distribution system.
9. Arizona Department of Environmental Quality approves
the quantity and quality of the water supply.

10. Arizona Department of Environmental Quality approves
the use and design of the sewage treatment facility for
this development.
11. Adequate parking shall be implemented in accordance
with the Mohave County Zoning Ordinance.
12. The water system will provide adequate flows for fire
protection as acceptable and prescribed by the Lake
Mohave Ranchos Fire Department.
13. The owner/developer shall, through sound engineering
practices, develop a drainage plan and cause the
drainage related improvements to be completed as
recommended and approved by the County Engineer (-and
other government agencies as required) as well as
address drainage flowing through the site as well as
those created on the site so as to not adversely affect
downstream property owners.

14. That the Board of Supervisors accept the dedication of
a forty-two foot (42') right-of-way along Montgomery
Road (north property line) and the seventy (70') foot
right-of-way of North Sacramento Drive as it bisects
this property, with the granting of eight foot (8 I )
PUE's along Montgomery Road and both sides of North
Sacramento Drive as they are contiguous to this
property through the approval of the resolution

authorizing the zone change, and that the
dedication/granting statement and dedication/granting
be shown on the Parcel Plat.
15.
All street centerline monuments will be staked and
monumented in accordance with Mohave County Engineering
Standard Specification No. 102.
That the owner/developer shall obtain right-of-way for
and pave either Montgomery Road as an access to Highway
93 and as it is contiguous to this property or if
access to Highway 93 is not utilized, North Sacramento
Drive to the nearest paved road and as it is contiguous
to this property. The paving of the aforementioned
roads shall be placed on the center line of roadway
right-of-ways in a width and design as approved by the
County Engineer. In addition the applicant shall pave
the driveway access and parking in accordance with
Mohave County Standard Specification #171, or better.

17. If access to Highway 93 is utilized, an ADOT access
permit shall be obtained by the applicant.
18. As a condition of approval due to the intensity of this
project, the owner/developer is responsible for the
completion of these site improvements to insure the
proper health, safety, and welfare standards are
completed and shall provide an assurance for all
required development improvements as outlined in
Article V of the Mohave County Subdivision Regulations
or as approved by the Board.
19. Traffic enhancement costs as required by Mohave County
Road Department at the intersection of Montgomery Road
and Highway 93, or North Sacramento Drive and
Cottonwood Lane, both in design and construction and
signage, will be the responsibility of the
owner/developer and are a condition of approval for
this development. This will also apply to off premises
traffic signage as required by the County Engineer for
the approaches to and from the development. These are
one time costs only.
20. Any open lot storage must be related to or be an
accessory to the primary business. Such storage shall
be completely enclosed by a view-obscuring fence which
extends two (2') feet above the highest item to be
stored, with a minimum of six (6') feet and a maximum
of eight (8 ') feet in height. Such a fence shall
display no advertising. The storage area shall be

covered with a dust-proof surface. If crushed rock is
used for the dust-proof surface then the soil shall be
maintained in a weed free condition.
21.
A buffer in the form of a view obscuring fence shall be
provided to screen the M (Manufacturing) use(s) from
Highway 93 and adjoining non-industrial properties.
This buffer shall be properly maintained and kept in
good condition.
22.
Submittal of proof of ownership from current property
owner two weeks prior to the Board meeting on September
4, 1990.
23.
Such change shall not be effective for at least thirty
(30) days after approval of the change in
classification by the Board, being October 4, 1990, as
per A.R.S. 11-829E.
WHEREAS, the notice of hearing was published in the Mohave
~~ Daily Miner, a newspaper of general circulation in Kingman,
~~ Mohave County, Arizona on August 20, 1990, and posted August 17,
1990 as required by Arizona Revised Statutes, and the Mohave
County Zoning Regulations, and
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Tuesday, September 4, 1990 approved
this change in zoning as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
