PAGE 1 OF 4 NOHAVE COUNTY BOARD OF SUPERVISORS " RECORDING fEE 0.00 Me .,1.< . , . ~ RESOLUTION NO. 90-270 A RESOLUTION SETTING FORTH THE REZONING OF PORTIONS OF SECTIONS 4 & 5, TOWNSHIP 18 NORTH, RANGE 20 WEST, FROM: A-R/36A (AGRICULTURAL RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: SD/C (SPECIAL DEVELOPMENT/COMMERCIAL) ZONES, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 1, 1990, a public hearing was conducted to determine whether approval should be granted to Dr. Robert Richardson and Dr. Byron McKenzie, Needles, California for a rezoning from existing A-R/36A (Agricultural zone to SD/C Residential/Thirty-Six Acre Minimum Lot Size) (Special Development Commercial) zones, located in the South Mohave Valley area, and WHEREAS, this property is located approximately four (4 ) miles southwest of Oatman along Highway 66. This site was created from four (4) old mining claims and is currently vacant except for some old concrete buildings and foundations, and WHEREAS, review of floodplain map #040058-2475B indicates this area to be clear of flooding potential. All adjacent lands are owned by BLM. This area is not specifically included in any area plan. The nearest occupied land is Oatman (4+ miles) and Mountain View Ranches, Tract 4003, (approximately 6 miles). As far as zoning is considered, the drug rehabilitation center is being compared to a nursing home and thus falls within a C-2 designation, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on September 12, 1990 did generate a recommendation of approval of the zone change request with the following conditions noted: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County zoning Regulations. 2. That the ZONING PLAN be approved for SD/C (Special Development/Commercial) in accordance with Section 19 of the Mohave County Zoning Regulations. 3. Mining claims shall be consolidated into one (1) parcel of land. 4. The owner/developer shall cause drainage related improvements to be completed to assure that no surface drainage exits this site in excess of what would naturally exit under natural conditions. These improvements shall be approved by the County Flood Administrator. 5. Public Utility easements (PUE'S) shall be identified on the Parcel Plat that are agreeable with Utility Company guidelines. 6. That the buildings meet or exceed the minimum standards of the 1988 Uniform Building Code for construction and F ire Code. Building permits are required for this facility. 10. All street centerline monuments will be staked and monumented in accordance with Mohave County Engineering Standard Specification No. 102. 11. A condition of approval due to the location and type of development would be that the owner/subdivider is responsible for the completion of the improvements and shall provide an assurance for all required development improvements as outlined in Article V of the Mohave County Subdivision Regulations or as approved by the Board. 12. The owner accepts that whenever a ~SD~ zone is granted, each phase or stage of development of building proposals shall be submitted to the planning staff, to be evaluated and compared with the approved zoning plan before any permits may be granted. 13. Any significant change (as determined by the Planning Director - appealable to the Planning Commission) in the approved zoning plan shall require a rehearing on the change before the Commission, with a final determination to be made by the Board. 14. Staff will maintain the most current approved ZONING PLAN on file in the master zoning folder for reviews. 15. The use of this property may not be changed by the owner/developer or subsequent owners as it is approved unless subsequently approved by the Board in accordance with Arizona Statutes Annotated, Title II, Chapter 6, Section 11-832.1. 16. Such change shall not be effective for at lease thirty (30) days after final approval of the change in classification by the Board, being NOVEMBER 1, 1990, as per A.R.S. 11-829E. . .GE 4 OF BK 1300 PG It 3H (FEE~90- 69897 } Resolution No. 90-270 Page 4 WHEREAS, the notice of hearing was published in the Mohave Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on August 24, 1990, and posted August 29, 1990 as required by Arizona Revised Statutes, and the Mohave County zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 1, 1990 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein. ;:~~ ~:;:~' " ;~~~ ~...~~ MORAVE COUNTY BOARD OF SUPERVISORS d~ .f1~ Lois J.
