RESOLUTION NO. 90-269
A RESOLUTION SETTING FORTH THE REZONING OF THE W~ SE~ SECTION 25,
TOWNSHIP 19 NORTH, RANGE 22 WEST, TO BE KNOWN AND SUBDIVIDED AS
CHARISMA, TRACT 4109, FROM: A-R (AGRICULTURAL RESIDENTIAL) ZONE,
PROPOSED TO BE: SD/R (SPECIAL DEVELOPMENT/RESIDENTIAL) AND SD/C
(SPECIAL DEVELOPMENT/COMMERCIAL) ZONES, LOCATED IN THE SOUTH
MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on October 1, 1990, a public hearing was
conducted to determine whether approval should be granted to

~~ existing A-R (Agricultural Residential) zone to SD/R (Special
Development
Residential)
and
SD/C
(Special
Development
Commercial) zones, located in the South Mohave Valley area, and
WHEREAS, Charisma, Tract 4109, is located approximately
three (3) miles south of Bullhead City and approximately one &
one-half (1.5) miles east of Highway 95, and has frontage on the
north side of Joy Lane, and
WHEREAS, the preliminary plan was approved, with extensive
conditions, at the July 2, 1990 Board meeting, through Resolution

1.9 acre C-1 (Neighborhood Commercial) area at the Joy Lane/Bison
Avenue intersection, a five (5) acre R-M area fronting on Joy
Lane, and the remainder of the approximately 73 acres being R-O.
Average lot size the approximately 209 single family residential
lots is 7,200 square feet and they are proposed to be developed
in 2 or 3 phases. Access for the single family residential area
is primarily along Bison Avenue as it extends northward along the
east side of this project.
The R-M and C-1 land uses will have
access on Joy Lane. The zoning request is in conformance to the
South Mohave Valley Area Plan for this area, and
WHEREAS, a public hearing before the Mohave County Planning
and Zoning Commission on September 12, 1990 did generate a
recommendation of approval of the zone change request with the
following conditions noted:
1. The applicant comply with all applicable provision of
Sections 25, 26, 27, and 31 of the Mohave County Zoning
Regulations.
2. That the ZONING PLAN be approved for a SD/R (Special
Development/Residential) and SD/C (Special
Development/Commercial) in accordance with Section 19
of the Mohave County Zoning Regulations.
3. The establishment of minimum lot area based on the size
of the parcels per the recorded Final Plat.

The owner accepts that whenever a ~SD~ zone is granted
each phase of stage of development of building
proposals shall be submitted to the planning staff, to
be evaluated and compared with the approved zoning plan
before any permits may be granted.

NOTE:
5. Any significant change (as determined by the Planning
Director - appealable to the Planning Commission) in
the approved zoning plan shall require a rehearing on
the change before the Commission, with a final
determination to be made by the Board.
6. Staff will maintain the most current approved ZONING
PLAN on file in the master zoning folder for reviews.
7. The use of this property may not be changed by the
owner/developer or subsequent owners as it is approved
unless subsequently approved by the Board in accordance
with Arizona Statutes Annotated, Title II, Chapter 6,
Section 11-832.
THE FOLLOWING CONDITIONS RELATE TO THE
MULTIFAMILY/COMMERCIAL DEVELOPMENT AREAS.

Arizona Department of Water Resources approved the
water supply and distribution system.
9. Arizona Department of Environmental Quality approves
the quantity and quality of the water supply.
10. Adequate parking shall be implemented in accordance
with the Mohave County Zoning Ordinance.
11. Arizona Department of Environmental Quality approves
the use and design of the sewage treatment facility for
this development.
12. Formal notification has been received by staff that the
wastewater from this site can be handled and will be
accepted by the Fort Mojave Tribal Utilities Authority
Waste Water Project. Further, the South Bermuda Water
Company has committed to supply the water.
13. The water system will provide adequate flows for fire
protection. Fire hydrants conforming to the minimum
County Standards shall be provided and located no more
than seven hundred fifty (750') feet apart and/or such
standards as acceptable and prescribed by the Fort
Mojave Mesa Fire Department.
14. The owner/developer shall, through sound engineering
practices, develop a drainage plan and cause the
drainage related improvements to be completed as
recommended by the project engineer and approved by the
County Engineer (and other government agency(s) as

required) as well as address drainage flowing through
the site as well as those created on the site so as to
not adversely affect downstream property owners.
The project design will allow for adequate PUE' s to
extend underground electric and telephone services to
each structure or facility site in accordance with
Arizona Corporation Commission Regulations as well as
other essential utility services such as water, sewer,
and fire flow.
All street centerline monuments will be staked and
monumented in accordance with Mohave County Engineering
Standard Specification No. 102.
As a condition of approval due to the mixture of this
project, the owner/developer is responsible for the
completion of these site improvements to insure the
proper health, safety, and welfare standards are
completed and shall provide an assurance for all
required development improvements as outlined in
Article V of the Mohave County Subdivision Regulations
or as approved by the Board.
18. If food services are proposed on the commercial
property, the Mohave County Health Department shall
grant approval of the facility under their guidelines.
19. The rezone shall not become effective until the Final
Plat has been recorded.
WHEREAS, the notice of hearing was published in the Mohave
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona on August 24, 1990, and posted August 29,
1990 as required by Arizona Revised Statutes, and the Mohave
County Zoning Regulations, and
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
