BK 1800 PG 3J OFFICIAL RECORDS OF MOHAVE COUNTY, A: *JOAM MCCALL, MOHAVE COUNTY RECORDEr, 4 -' --~j RESOLUTION NO. 90-264 A RESOLUTION SETTING FORTH THE REZONING OF THE SE~ SE~ SECTION 27, TOWNSHIP 19 NORTH, RANGE 22 WEST, TO BE KNOWN AND SUBDIVIDED AS VERA VERDE ESTATES, TRACT 4110, FROM: A-R (AGRICULTURAL RESIDENTIAL) ZONE, PROPOSED TO BE: SD/R-O (SPECIAL DEVELOPMENT/SINGLE FAMILY RESIDENTIAL/MOBILE HOMES PROHIBITED) AND SD/C (SPECIAL DEVELOPMENT/COMMERCIAL) ZONES, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 1, 1990, a public hearing was conducted to determine whether approval should be granted to "'5Jr'" .,::.:~ ~~:~~l r';;J Salvatore J. DuBato, Vera Verde Partners, Bullhead City, Arizona for a rezoning from existing A-R (Agricultural Residential) zone to SD/R-O (Special Development/Single Family Residential/Mobile Homes Prohibited) and SD/C (Special Development/Commercial) zones, located in the South Mohave Valley area, and WHEREAS, Vera Verde Estates, Tract 4110, is located approximately three (3) miles south of Bullhead City and directly west of Highway 95. This subdivision occupies the northwest corner of the Joy Lane/Highway 95 and extends west along Joy Lane. Vera Verde is a mixed use subdivision with two (2) commercial malls on the east twenty-four (24) acres of the .~ project and sixty-two (62) single family lots with a density of L?i~'"l l-. ,'. Resolution No. 90-264 Page 2 WHEREAS, the South Mohave Valley Area Plan shows this area as A-R zoning, however, an amendment to the plan has been approved via Resolution No. 90-259 as a prerequisite to considering this request, and WHEREAS, surrounding land uses consist of undeveloped A-R (Agricultural-Residential) zoned parcels to the west separating this Tract from the Fort Mojave Indian Reservation, platted subdivisions lie north and south, with commercial properties fronting on Highway 95. East of Highway 95, both north and south of Joy Lane is a rapidly changing pattern of mixed land uses with C-2H (General Commercial Highway Frontage) zoning fronting Highway 95, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on September 12, 1990 did generate a recommendation of approval of the zone change request with the following conditions noted: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. 2. Mohave County Environmental Health approves sewage disposal systems for the commercial center. 3. If food services are proposed, the Mohave County Health Department grant approval of the facility under their guidelines. 4 . Parking provlslons shall be comprised of asphaltic cement, in accordance to Standard Specification #171 or PAGE 2 OF 4 BK 1800 PG 320 (FEEt90- 69891) . . .""' Resolution No. 90-264 Page 3 better and that such paving be completed within ninety (90) days of the certificate of occupancy granted the building. 5. The owner accepts that whenever ~ SD ~ zone is granted, each phase or stage of development or building proposals shall be submitted to the planning staff, to be evaluated and compared with the approved zoning plan before any permits may be granted. 6. Any significant change (as determined by the Planning Director - appealable to the Planning Commission, in the approved zoning plan shall require a rehearing on the change before the Commission, with a final determination to be made by the Board. 7 . The use of this property may not be changed by the owner/developer or subsequent owners as it is approved unless subsequently approved by the Board in accordance with Arizona Statutes Annotated, Title II, Chapter 6, Section 11-832. r~ ij,s~~ ,'d;'ai 8. The rezone shall become effective upon the recording of this subdivision's Final Plat. WHEREAS, the notice of hearing was published in the Mohave Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on August 24, 1990, and posted August 29, .1990 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 1, 1990 approved this change in zoning as recommended by the Mohave County Planning and {~ Zoning Commission and outlined herein. rjf~" ~~~~:1' (t\ t..J PAGE 3 OF 4 BK 1800 PG 321 (FEEt90- 69891) -- .
