PAGE 1 OF 2 BOS RECORDIWG fEE 0.00 Ne RESOLUTION NO. 90-339 A RESOLUTION DENYING THE REZONING OF A PORTION OF THE W~ W~ SEC'l'ION 23, TOWNSHIP 16~ NORTH, RANGE 18 WEST, FROM: A-R/36A (AGRICULTURAL RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: C-2 (GENERAL COMMERCIAL) ZONE, LOCATED IN THE YUCCA AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 3, 1990, a public hearing was conducted to determine whether approval/denial should be granted to Victor & Naomi Gallardo, Lake Havasu City, Arizona, for a rezoning from existing A-R/36A (Agricultural-Residential/Thirty- Six Acre Minimum Lot Size) zone to C-2 (General Commercial) zone, located in the Yucca area, and WHEREAS, Gem Acres interchange is located approximately 6 miles south of the Yucca Interchange on I-40. The subject property is accessed from I-40 via a frontage road on the east side of the interchange, north approximately one (1) mile, thence east along an unnamed access road approximately one and one-half (1.5) miles to the property, and WHEREAS, review of floodplain map #040058-2850B indicates this parcel is bisected by a major wash which is designated as a FEMA flood zone, and '- WHEREAS, th"PPlicant wishes to rez. the northern 10 acres of this 129.4 acre parcel to be commercial in order to facilitate the establishment of a swap meet. The remainder of the parcel is slated for a potential R-V park at some future time, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 14, 1990, there was generated a recommendation of DENIAL of the zone change request from the Planning and Zoning Commission based on the petition of nineteen (19) surrounding property owners and the isolated nature of the proposed commercial use in relation to other commercial uses, the impact to the area, and WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on November 18, 1990, and posted November 16, 1990 as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 3, 1990 denied this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
