RESOLUTION NO. 90-338
A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO
ESTABLISH A MOBILE HOME AS A RESIDENCE IN A C-2 (GENERAL
COMMERCIAL) ZONE, LOCATED IN A PORTION OF THE SW~ NW~ SECTION 33,
TOWNSHIP 41 NOR'l'H, RANGE 15 WEST, IN THE ARIZONA STRIP AREA,
MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held December 3, 1990 a public hearing was
conducted to determine whether approval should be granted to
Lawrence D. Smith and Larry T. Smith, Clearfield, Utah for a

:'0;:i'l zoning Use Permit to establish a mobile home as a residence in a

C-2 (General Commercial) zone, and
WHEREAS, Section 33 is located approximately 1.5 miles north
of the 1-15 and Highway 91 junction, also known as the
Littlefield Interchange.
The subject property is accessed from
Highway 91 via an access easement at the quarter section line
that is unofficially known as Mitchell Drive, thence west
approximately one-half (.5) mile to Arizona Avenue, thence north
approximately three-quarters (.75) mile to an unnamed access
easement thence east approximately 350 feet to the parcel, and

WHEREAS, review of floodplain map #040058-025B indicates
this area to be clear of flooding potential.

uses for this .52 acre parcel consist of residential uses and
some vacant land. Although the area has commercial zoning there
are very few parcels which have commercial uses on them, and
WHEREAS, a public hearing before the Mohave County Planning
and Zoning Commission on November 14, 1990 did generate a
recommendation of conditional approval of the Zoning Use Permit
with the following conditions:
1. That zoning/Building permit(s) be obtained.
2 .
If construction or use has not commenced within one (1)
year of Board approval of the Zoning Use Permit or if
the use has been discontinued for six (6) months, then
approval shall terminate at that date.

This Zoning Use Permit is subject to revocation upon
sixty (60) days notification by the Board of
Supervisors, if in the opinion of the Commission and
Board the continued use of the property would be
contrary to the public health, safety, and welfare.
4. That the mobile home shall be used as a residence only
and shall not be used in conjunction with the
underlying C-2 (General Commercial) zoning. I f the
underlying C-2 zoning were to be exercised by the owner
of the property then a rehearing of this ZUP would be
required.
5. The mobile home shall have an affixed HUD label.
6. If these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.

WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona on November 18, 1990, and posted November
19, 1990 as required by the Arizona Revised Statutes and the
Mohave County Zoning Regulations, and
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, December 3, 1990 approved
this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission, subject to the conditions
outlined herein.
