A RESOLUTION SETTING FORTH APPROVAL OF A FINAL SUBDIVISION PLAN
FOR THE HIGHLANDS, TRACT 4091-A, A SUBDIVISION OF A PORTION OF
THE W~ SECTION 7, TOWNSHIP 18 NORTH, RANGE 21 WEST, GILA & SALT
RIVER BASE & MERIDIAN, LOCATED IN THE SOUTH MORAVE VALLEY AREA,
MORAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on November 5, 1990, a public hearing was
conducted to determine the final subdivision plan for THE
HIGHLANDS, Tract 4091-A, located in the South Mohave Valley area,
and
WHEREAS, the owner/developer of this tract is HOLPAL, a
California Ltd. Partnership, Santa Monica, California. The
engineer responsible for the preparation of the drainage report
and design of this subdivision is William E. Miller, Holland
West, Inc., Englewood, Colorado, and
WHEREAS, the drainage of this subdivision will be handled
through sheet
flow drain channels,
ponding and control
structures. The applicant intends to connect into the Fort Mojave
Tribal Utilities sewage system along Vanderslice Road, and

WHEREAS, access is provided to this plat from Boundary Cone
Road via Vanderslice Road, and
WHEREAS, the submitted preliminary subdivision plan depicts
320 acres subdivided into 770 lots.
This phase (Tract 4091-A)
has 136 lots on 61 acres, and
WHEREAS, it is intended that all lots are to be zoned R-l
(Single Family Residential) as approved by the Board on October
2, 1989 by Resolution No. 89-69, and
WHEREAS, the adjoining property to the north is a new
subdivision of 6,000 square foot lots, Mountainside Ranch, Tract
4106. Vacant land lies east, west, and south of this plat, and
WHEREAS,
reviews have been received from the County
Engineer/Floodplain Administrator,
Utilities
Rural
Citizens
Company, Inc., Mohave Valley Fire Department, Mohave County
Health Department, Mohave Valley Water Company, Mohave Valley
Irrigation & Drainage District, Fort Mojave Tribal Council, and
Fort Mojave Tribal Utilities,
and incorporated into the
evaluation of this tract, and
WHEREAS, the owner/subdivider will obtain the right-of-way
from the Bureau of Indian Affairs (BIA) for and pave Vanderslice

Road along the west boundary of this subdivision; if the
development of this subdivision dictates the construction of the
roadway along Vanderslice Road prior to the granting of roadway
easement from the BIA in Section 12, then the subdivider shall
pave the entire roadway for Vanderslice Road within Section 7 and
move the poles in the easement to the eastern edge of the thirty-
five (35 ') foot roadway dedication for Vanderslice Road at his
expense; the owner/subdivider shall agree that all streets within
the subdivision will be paved with asphaltic concrete, including
curb and gutter as shown on the improvement plans, as recommended
by the project engineer in accordance with County Standards or
better;
a water
supply and distribution system will be
constructed to serve each lot; the water supply and distribution
system will provide for fire flows and fire hydrants conforming
to the requirements of the Mohave Valley Fire Department; grading
and drainage related improvements will be made as recommended by
the
design
engineer
in
the
submitted
drainage
report;
arrangements will be made to extend underground electric and
telephone service to each lot in accordance with Arizona
Corporation Commission Regulations; sewage lines will be extended
to each lot and connected to mains that enter the Fort Mojave
Tribal sewage system; all lots and street centerline monuments
will be staked and monumented in accordance with Standard
Specification No. 102; and as a condition of approval, the
owner/subdivider is responsible for the completion of these site

improvements and shall provide an assurance for all required
subdivision improvements in accordance with Article V of the
Subdivision Regulations, and
WHEREAS,
a petition of exception was
approved with
Resolution No. 90-77 for lots with double frontage, which require
a non-access easement and barrier; for lot lines that are neither
radial or perpendicular to the street lines; interior streets are
to have inverted crowns; eight (8') foot public utility easements
will be placed at the front of each lot instead of back lot line
easement; and some blocks are greater than the maximum allowable
block length, and
NOW THEREFORE BE IT RESOLVED, that the Board approved said
final plan conditional to the following:
1. The developer will make the same commitments for
improvements in the prospectus to the State Real Estate
Commission as is required for approval of this tract by
the Board of Supervisors.
2. The owner/subdivider shall cause the drainage related
improvements to be completed as recommended by the
project engineer and outlined in the detailed drainage
report as it pertains to this phase of the development;
a grading plan shall be provided as a part of the
improvements plans for this subdivision. The engineer
of record shall provide a design acceptable to the
County Engineer that the water sheet flow in the Zone
"C" crossing the EI Paso Gas Easement at the Northeast
side of this submittal can be adequately picked up and
routed as to mitigate impact during the 100 year storm
flow prior to the recordation of this plat.

3. The Board of Supervisors approves the zone change as
delineated in Resolution No. 89-69 and that this zoning
be in effect upon the recording of this final plat.
4. The final plat will include public utility easements
at the front of the lots and/or as necessary to serve
these lots with underground utilities.
5. The minimum lot size shall be 8,000 square feet in
area.
6. A signed copy of CC&R's reflecting perpetual
maintenance of street dividers and other parcels.
7 . A copy of the property owners organization and draft
report to the Real Estate Commission.
8. The owner/subdivider shall obtain a report from the
Arizona Department of Environmental Quality regarding
the approval for connections to the Fort Mojave Tribal
sewage disposal system and for the water supply. The
subdivider shall provide an approval from the
Department of Water Resources stating that there is
adequate water for this subdivision prior to
recordation as per Arizona Revised Statutes.
9. The final I2lat for Tract 4091-A including the
Ded.icatlOil wi-rr- need to be properly executed anq/or
ratified ~ll parties-having any record titl~
interest i!! the land being subdivided and included
within this subdivision boundary.
10. The County Engineer shall confirm the amount of bond as
submitted in the amount of $1,546,496.00, in the cost
estimate to assure all necessary items are covered to
assure completion of all improvements as the face of
the bond states only items listed in the agreement are
covered.
11. A performance bond covering labor and materials for
$1,546,496.00 + must be posted based on the County
Engineer's evaluation and approval of the submitted
cost estimates.
12. There are several ministerial corrections that need to
be taken care of by the Project Engineer prior to the
recordation of this tract. The Planning Commission
Staff feels confident that these are minor in nature
and will be met to the satisfaction of staff prior to
recordation. The comment of most concern is the

paving of Vanderslice Road and the subdivider agrees to
handle that as outlined in this resolution.
NOW THEREFORE BE IT FURTHER RESOLVED, upon receipt of or
evidence that these conditions have been met together with the
executed mylars and appropriate recording fees, the Director of
Planning and Zoning will obtain the necessary signatures from the
County Departments and officials and cause the final plat to be
recorded, and
NOW THEREFORE BE IT FURTHER RESOLVED, that notice of hearing
has been met and published throughout this subdivision process
and the public was afforded notice of this final action through
advertisement of the Board of Supervisors' meeting for this date.
