PAGE 1 OF 6 !10HA'-iE WUlny BOARD OF SUPERVISORS RECOPDING FEE 0.00 He RESOLUTION NO. 90-328 A RESOLUTION SETTING FORTH APPROVAL OF A FINAL SUBDIVISION PLAN FOR LOS LAGOS, TRACT 4096-A, A SUBDIVISION OF A POR'rION OF' SECTION 1, TOWNSHIP 18 NORTH, RANGE 22 WEST, GILA & SALT RIVER BASE & MERIDIAN, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 5, 1990, a public hearing was conducted to determine the final subdivision plan for LOS LAGOS, Tract 4096-A, located in the South Mohave Valley area, and [',:,',',," (' WHEREAS, the owner/subdivider of this tentative tract is Los Lagos Limited Partnership, Newport Beach, California. The engineer responsible for the preparation of the drainage report and design of this subdivision is William E. Miller, P.E., Holland West, Inc., Englewood, Colorado, and WHEREAS, the proposed subdivision Tract no. 4096-A consists of 457 lots of the originally approved 991 unit development scheduled for the 480 acres that entails the approved plan. This unit of the proposed subdivision is bounded by the golf course I'.' " and drain channel on the south, Lipan Boulevard on the. north, Mountain View Road on the west, and Sun Valley, Tract 4064, on I , the east. The drainage of this subdivision will be a continuance of the revised preliminary plan and drainage from Sun Valley, Tract 4064 which has been redesigned by the engineer of Tract # 4096-A and has been submitted by the Engineer of Record for Tract # 4064. Sun Valley lies to the northeast of Los Lagos. The applicant intends to merge his sewage infrastructure with the treatment plant in the Desert Lakes and Golf Course Tract, and WHEREAS, access is provided to this plat from Highway 95 via Lipan Boulevard to Mountain View Road or directly of f of Lipan Boulevard. With the development of Parcel Q, the Multifamily Parcel, Mountain View Road will be developed to the South tying in access from Boundary Cone Road, via Highway 95, and WHEREAS, the submitted final subdivision plan depicts 240 + acres subdivided into 457 lots and 30 parcels, and WHEREAS, it is intended that this plat is to be zoned S-D (Special Development) with R-O/S-D (Single Family Residential/Homes Only/Special Development) zone to apply to individual lots, Parcel Q designated for R-M/S-D (Multiple Family/Special golf course/drainage Development), and the areas/lakes and club house area zoned C-RE/S-D (Commercial Recreation/Special Development) by the Board of Supervisors on February 5, 1990 by Resolution No. 90-36, and PAGE 2 OF 6 BK 1817 PG 15 (FEEt90- 77617) . . . Resolution No. 90-328 . Page 3 WHEREAS, the adjoining property to the north is a subdivision of 6,000 square foot lots and a golf course, Desert Lakes, Tract 4076-C. South of this final plat is the remainder of the approved preliminary plat for Los Lagos. To the east is the approved preliminary plat of Sun Valley, Tract 4064. The property to the west is Fort Mojave Indian Reservation land, and WHEREAS, reviews have been received from the County Engineer/Floodplain Administrator, Citizens Utilities Rural Company, Inc., Mohave Electric Cooperative, Planning and Zoning staff, the Fort Mojave Mesa Fire Department, the Mohave County Health Department, Bermuda Water Company, Mohave Valley ( Irrigation and Drainage District, and Sorrenson Utili ties, and \ ~. incorporated into the evaluation of this tract, and WHEREAS, the approval of this subdivision was based on the understanding of the Commission and Board of Supervisors that the interior roads and parcels will be private roads and parcels, the roads shall be constructed to County standards and maintained by the developer or a perpetual corporate entity established by the developer to maintain the roads and parcels, and WHEREAS, the owner/subdivider will obtain right-of-way for the west boundary of Mountain View Road from Lipan Boulevard south to Boundary Cone Road, and pave Mountain View Road from Lipan Boulevard to Vista Laguna Drive, and with the approval of Plans for Parcel Q, Mountain View Road will be paved south to Boundary Cone Road. Page 4 eventual maintenance by Mohave County, and PAGE ~ OF 6 BK 1817 PG 17 (FEE~90- 77617) WHEREAS, the owner/subdivider shall agree that all streets within the subdivision will be paved with asphaltic concrete, including curb and gutter as shown on the improvement plans, as recommended by the project engineer in accordance with County Standards or better; a water supply and distribution system will be constructed to serve each lot; the water supply and distribution system will provide for fire flows and fire hydrants conforming to the requirements of the Fort Mojave Mesa Fire Department; grading and drainage related improvements will be made as recommended by the design engineer in the submitted drainage report and improvements plans; arrangements will be made . , ' to extend underground electric and telephone service to each lot in accordance with Arizona Corporation Commission Regulations; each lot will be connected to a community sewer plant; all lots and street centerline monuments will be staked and monumented in accordance with Standard Specification No. 102; and as a condition of approval, the owner/subdivider is responsible for the completion of these site improvements and shall provide an assurance for all required subdivision improvements in accordance with Article V of the Subdivision Regulations, and WHEREAS, a petition of exception was approved with t...';, Resolution No. 90-1 for lots with double frontage, which require ,',' a non-access easement and barrier; for lot lines that are neither ",I, " radial or perpendicular to the street line; some interior streets are to have inverted crowns; eight (8') foot public utility .. ~. . Page 5 .r .. pAGE 5 OF 6 BY-. 1.817 PG t8 (FEH90- 77617) easements will be placed at the front of each lot instead of back :~ . i I.";' lot line easements; storm water flowing in some streets will exceed the runoff generated by the ten (10) year frequency storm; certain rights-of-way and easements presently encumber the property, and NOW THEREFORE BE IT RESOLVED, that the Board approved said final plan conditional to the following: 1. The developer will make the same commitments for improvements in the prospectus to the State Real Estate Commission as is required for approval of this tract by the Board of Supervisors. 2. The owner/subdivider shall cause the drainage related improvements to be completed as recommended by the project engineer and outlined in the detailed drainage report; the grading plan shall be provided as a part of the submittal for this subdivision. 3. The owner/subdivider shall obtain a report from the Arizona Department of Water Resources and Arizona Department of Environmental Quality regarding availability of water for domestic uses. 4. The Board of Supervisors approved the zone change as delineated in Resolution No. 90-36 and that this zoning be in effect upon the recording of the final plat. 5. The final plat will include public utility easements at the front of the lots and/or as necessary to serve these lots with underground utilities. 6. The minimum lot size shall be 6,000 square feet in area. 7. The final plat for Tract 4096-A including the Dedication will need to be properly executed an<:!lor ratified ~ all parties havigg any record ti!l~ interest ln the land beiJ!g subdivided and included within this subdivision boundary. 8. The project engineer has revised the final plat to conform to all the comments made by staff on their review, except to provide the submittal of laboratory test for aggregate base (A.B.) material for less than 6" as requLL-ed by regulation. If the 4" A.B. material as set forth in the cost estimate is to be used then a labora'Lory test proving the stability of 4" A.B. needs . Resolution No. 90-328 . Page 6 PAGE 6 OF 6 BK 1817 PG 19 (FEE~90- 77617) to be submitted. The lack thereof shall cause an increase in the cost estimate and associated bond for improvements to reflect 6" A.B. material. 9. The owner/subdivider shall obtain a report from the Arizona Department of Environmental Quality regarding connections to Sorrenson Utilities sewage disposal plant at Desert Lakes. 10. A complete list of all improvements and their costs shall be approved by the County Engineer and the Engineer confirming the amount of bond necessary to assure completion of all improvements on the face of the bond. 11. A bond or other acceptable surety be deposited for assurance of completion of improvements. 12. A signed copy of the CC&R' s to include developer and property owners committal to care and maintenance of streets, lakes, parcels, etal. 13. Documents verifying the establishing of a corporate enti ty to assure perpetual maintenance of streets and facilities.
