PAGE 1 OF 4 MOliN)!: (:mmn BOARD OF SUPERVISORS REWf:DIHG fEE 0.00 He RESOLUTION NO. 90-326 A RESOLUTION SETTING FORTH THE REZONING OF A PORTION OF THE NE~ SE~ OF SECTION 34, TOWNSHIP 21 NORTH, RANGE 17 WEST, FROM: C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) ZONE, PROPOSED TO BE: C- MO/I0A (COMMERCIAL MANUFACTURING/OPEN LOT STORAGE/TEN ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE KINGMAN AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 5, 1990, a public hearing was conducted to determine whether approval should be granted to Victor and Deloris Mack, Kingman, Arizona for a rezoning from existing C-2H (General Commercial) zone to C-MO/10A (Commercial Manufacturing/Open Lot Storage/Ten Acre Minimum Lot Size) zone, located in the Kingman area, and WHEREAS, Section 34 is located approximately 2 miles southwest of Kingman on Highway 66. This site was previously known as Klondike minesite #4005. Review of floodplain map #040058-2325B indicates this area may be affected by a FEMA designated floodzone. Surrounding land uses consist of two residences to the south, businesses to the north and an apartment building immediately adjoining the proposed site. The applicant states that this site was previously utilized as a cement plant. The applicant wishes to establish a metal, wood and rock manufacturing business with outside storage , and ....- .tit- 1'"--'- r" i}',"t I', ", Ii ' ~ L' . . ~AGE 2 OF 4 8K 1817 PG 11 (FEE~90- 77616) Resolution No. 90-326 Page 2 WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on October 10, 1990 did generate a recommendation of approval of the zone change request with the following conditions noted: 1. The zone shall be identified as C-MO/I0A (Commercial Manufacturing/Open Lot Storage/ten acre minimum lot size). 2. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. 3. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 4. That the two parcels being rezoned be combined via parcel plat. 5. The establishment of a mlnlmum lot size based on the size of parcel per the recorded Parcel Plat. 6. The Parcel Plat shall show any surface drainage. 7 . Any open lot storage must be related to or be an accessory to the primary business. 8. Such storage shall be completely enclosed by a view- obscuring fence which extends two (2') feet above the highest item to be stored, with a minimum of six (6') feet and a maximum of eight (8') feet in height. Such a fence shall display no advertising. 9. The applicant shall pave the driveway access and parking in accordance with Mohave County Standard Specification #171, or better. The storage area shall be covered with a dust-proof surface. If crushed rock is used for the dust-proof surface then the soil shall be maintained in a weed free condition. 10. That pertinent building/zoning permits be obtained. 11. The development shall have adequate parking facilities. 12. Arizona Department of Environmental Quality approves the quantity and quality of the water supply. 14. Arizona Department of Environmental Quality approves the use and design of the sewage treatment facility for this development. 15. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being December 5, 1990, as per ARS 11-829E. 16. If these conditions are not met within one (1) year this approval shall be void. I f at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832, WHEREAS, the notice of hearing was published in the Mohave Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on October 19, 1990, and posted October 18, 1990 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 5, 1990 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein. .
