RESOLUTION NO. 90-322
A RESOLUTION SETTING FORTH THE REZONING OF PARCEL 17, IN SECTION
7, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM: A-R/I0A (AGRICULTURAL
RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-
R/5A (AGRICULTURAL RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) AND C-
2H/3A (HIGHWAY COMMERCIAL/THREE ACRE MINIMUM LOT SIZE) ZONES,
LOCATED IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on November 5, 1990, a public hearing was
conducted to determine whether approval should be granted to
Donald Kopczick and Larry Brown, Simi Valley, California for a
rezoning from existing A-R/10A (Agricultural Residential/Ten Acre
Minimum Lot Size) zone to A-R/5A (Agricultural Residential/Five
Acre Minimum Lot Size) and C-2H/3A (Highway Commercial/Three ~cre
Minimum Lot Size) zone, located in the Golden Valley area, and
WHEREAS, Section 7 is located 6 miles west of the Highway 68
and 93 junction and is bisected by Highway 68.
The subject
property occupies the northwest corner of Highway 68 and Colorado
Road.
Review of flood plain map #040058-2325B indicates this
parcel is not affected by the major wash running through the
central portion of this section.
Surrounding land uses consist
of some homes in Golden Sage Ranchos Unit 58 to the north with
the remainder being vacant land. The applicant wishes to obtain
the commercial zoning in order to establish an office complex
with one of the tenants being First American Title, and

WHEREAS, a public hearing before the Mohave County Planning
and Zoning Co~nission on October 10, 1990 did generate a
recommendation of approval of the zone change request with the
following conditions noted:
1. The applicant comply with all applicable provisions of
Sections 25, 26, 27, & 31 of the Mohave County Zoning
Regulations.
2. This action will effectively create three parcels.
Therefore, staff recommends the northern parcel of 5+
acres be rezoned from A-R/IOA to A-R/5A and the central
3+ acre parcel be rezoned from A-R/IOA to C-2H/3A and
the parcel south of Highway 68 should remain A-R/I0A.
3. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations for the portion of Parcel 17
north of State Highway 68.
4. The establishment of a minimum lot size based on the
size of parcels per the recorded Parcel Plat.
5. Each parcel shall have legal access.
6. The northern parcel meet or exceed five (5) acres
exclusive of road easements.
7 . The central parcel meet or exceed three ( 3) acres
exclusive of road easements.
8 .
That the northerly fifty (50) feet of the roadway
easement known as Supai Drive; the westerly fifty (50)
feet of the roadway easement known as Colorado Road,
and the easterly thirty (30) feet of the roadway
easement known as Lowell Road be abandoned as they are
contiguous to this property and that they revert to
acreage. That the Board of Supervisors accept the
dedication of a fifty (50') foot road right-of-way
along Colorado Road; a twenty (20') foot road right-of-
way along Supai Drive and a thirty (30) foot road
right-of-way along Lowell Road as they are contiguous
to this property. In conjunction with a twenty (20')
foot radius at the intersections of the above mentioned
roads as well as Highway 68. Along with an eight (8')
foot PUE on the above mentioned three (3) roads as they
are corlliguous to this property.

This shall be approved through the recording of the
resolution authorizing this zone change and that the
dedication statement and dedications shall be shown on
the Parcel Plat. NOTE: Standards usually allow for
frontage roads however, ADOT in a written memo has
indicated their desire to not have a frontage road in
this section.
9. The Parcel Plat shall show any surface drainage.
10. The development shall have adequate parking facilities.
11. Arizona Department of Water Resources approves the
water supply and distribution system.
12. Arizona Department of Environmental Quality approves
the quantity and quality of the water supply.
13. Arizona Department of Environmental Quality approves
the use and design of the sewage treatment facility for
this development.
14. All paving (driveways and parking) be paved in
accordance with Mohave County Standard Specification
#171 or better, and that such paving be completed
within ninety (90) days of the certification of
occupancy granted the building.
15. Building/zoning permit(s) shall be obtained.
16. A one (I') foot vehicle non-access easement and
physical barrier a minimum of three (3') feet in height
will need to be provided on the perimeter of the
development frontage adjacent to Highway 68 right-of-
way.
17. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors, being
December 5, 1990, as per ARS 11-829E.
18. I f these conditions are not met wi thin one (1) year
this approval shall be void. I f at the expiration of
this period the property has not been improved for the
use for which it was condItionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.

WHEREAS, the notice of hearing was published in the Mohave
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona on October 19, 1990, and posted October
18, 1990 as required by Arizona Revised Statutes, and the Mohave
County Zoning Regulations, and
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, November 5, 1990 approved
this change in zoning as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
