PAGE 1 OF 4 MDHAVE WUiHY BOARD OF SUPERVISORS i,'ECOfWHJ.G FEE 0.00 Ne RESOLUTION NO. 90-319 A RESOLUTION SETTING FORTH THE REZONING OF THE S~ SE\ SECTION 34, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM: A-R/36A (AGRICULTURAL RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/30A (AGRICULTURAL RESIDENTIAL/THIRTY ACRE MINIMUM LOT SIZE) AND A-R/15A (AGRICULTURAL RESIDENTIAL/FIFTEEN ACRE MINIMUM LOT SIZE) ZONES, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 5, 1990, a public hearing was conducted to determine whether approval should be granted to Dr. Deborah Medoff and Dr. James Ramaglino, Culver City, California for existing A-R/36A (Agricultural rezoning from a Residential/Thirty-six Acre Minimum Lot Size) zone to A-R/30A (Agricul tural Residential/Thirty Acre Minimum Lot Size) and A- R/15A (Agricultural Residential/Fifteen Acre Minimum Lot Size) zone, located in the Golden Valley area, and WHEREAS, Section 34 is located approximately 4 miles west of the Highway 68 and 93 junction and is approximately 4 miles sou~h of Highway 68. Access to the property from Highway 68 is via Aztec Road south approximately 4~ miles south to the northwest corner of Aztec Road and Shinarump Drive which this parcel occupies, and ~ " .,."'. ~.: . ~ :' ,'~. f.;...'" PAGE 2 OF 4 BK 1816 PG 988 (FEEt90- 77609) Resolution 90-319 Page 2 WHEREAS, review of floodplain map #040058-2325B indicates a portion of this parcel to be in a designated floodplain. Surrounding land uses consist of mostly vacant land and some residences, and WHEREAS, the applicant wishes to split this 75+ acre parcel into two 15+ acre and one 35+ acre parcels, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on October 10, 1990 did generate a recommendation of approval of the zone change request with the following conditions noted: 1. That the western parcel of 30+ acres be rezoned from A- R/36A to A-R/30A and the two eastern 18+ acre parcels be rezoned from A-R/36A to A-R/15A. 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3, The establishment of a m1n1mum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The two (2) most eastern parcels shall meet or exceed fifteen (15) acres exclusive of road easements. 6. The western parcel meet or exceed thirty (30) acres exclusive of road easements. 7. That the westerly fifty (50) feet of the roadway easement known as Shinarump Drive, be abandoned as they are contiguous to this property. The portions of the roadway easements abandoned shall be replaced by forty two (42) foot road right-of-way dedications and eight (8) foot Public Utility Easements. Resolution 90-319 pAGE 3 uF 4 BK 1816 PG 989 (FEE~90- 77609) Page 3 That the Board of Supervisors accept the dedication of a forty-two (42') foot right-of-way along Aztec Road and Shinarump Drive, and thirty (35') foot right-of-way along illnado Road, and a sixty (60') foot right-of-way along the southern projection of Arivaca Road as they are contiguous to this property. In conjunction with a twenty (20') foot radius at the intersections of Shinarump Drive with Aztec and Arivaca Roads. Along wi th an eight ( 8') foot PUE on the above mentioned roads as they are contiguous to this property. This shall be approved through the recording of the resolution authorizing this zone change and that the dedication statement and dedication be shown on the Parcel Plat. 8. The Parcel Plat shall show any surface drainage or FEMA flood zones. 9. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, being December 5, 1990, as per ARS 11-829E. 10. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Mohave Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on October 19, 1990, and posted October 18, 1990 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations, and y . .
