PAGE 1 OF 3 NOHiwE C:OUi4H BOARD OF SUPERVISORS RECOROWG fEE 0.00 He RESOLUTION NO. 90-309 A RESOLUTION SETTING FORTH THE REZONING OF LOT 49, MORAVE MESA, TRACT 1021, FROM: C-2 (GENERAL COMMERCIAL) ZONE, PROPOSED TO BE: C-MO/1A (COMMERCIAL MANUFACTURING/OPEN LOT STORAGE/ONE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 5, 1990, a public hearing was conducted to determine whether approval should be granted to Andrew A. Banks, Elouise E. Banks, Wayne C. Banks, and Jennie J. Banks, Mohave Valley, Arizona for a rezoning from existing C-2 (General Commercial) zone to C-MO (Commercial Manufacturing/Open Lot Storage) zone, located in the South Mohave Valley area, and WHEREAS, Mohave Mesa, Tract 1021, is located approximately two miles south of Bullhead City and west of Highway 95. Access to the subject property from Highway 95 is west via Hammer Road, a mid-section line road to Lakewood Road, thence south approximately 400 feet on the west side of the road to Lot 49. Lot 49 is currently occupied by a home and garage. Surrounding land uses consist of vacant land to the south, east, and west, with mobile homes to the north on Lots 55 and 48 which are zoned C-MO, and J,.".,-,. ~ .;~ .~ :..~ t.t;l, : .,.~ ( . ~ . .......~~ . . Resolution 90-309 PAGE 2 OF 3 BK 1816 PG 960 (FEE~90- 77601) Page 2 WHEREAS, this lot lies within the C-M and C-MO designated area as identified by the South Mohave valley area plan, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on October 10, 1990 did generate a recommendation of approval of the zone change request with the following conditions noted: 1. The applicant comply with all applicable prov1s1ons of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. 2. Any open lot storage must be related to or be an accessory to the primary business. 3. Such storage shall be completely enclosed by a view- obscuring fence which extends two (2') feet above the highest item to be stored, with a minimum of six (6') feet and a maximum of eight (8') feet in height. Such a fence shall display no advertising. 4. The applicant shall pave the driveway access and parking in accordance with Mohave County Standard Specification #171, or better. The storage area shall be covered with a dust-proof surface. If crushed rock is used for the dust-proof surface then the soil shall be maintained in a weed free condition. 5. The applicant shall obtain a building permit. 6. Arizona Department of Water Resources approves the water supply and distribution system. 7. Arizona Department of Environmental Quality approves the use and design of the sewage treatment facility for this development. 8. Arizona Department of Environmental Quality approves the quantity and quality of the water supply. 9. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, being December 5, 1990, as per ARS 11-029E. ~ :'") I,. ,., , ; ". , ,-_:--.7 .. . . If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Mohave Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on October 19, 1990, and posted October 18, 1990 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 5, 1990 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
