PAGE 1 OF 9 MOHAVE c:nmny BOARD OF SUPERVISORS RECORDING fEE 0.00 He RESOLUTION NO. 90-377 A RESOLUTION AMENDING PORTIONS OF THE MOHAVE COUNTY SUBDIVISION -REGULATIONS AND THE MOlffiVE COUNTY ZONING REGULATIONS DELETING/MODIFYING SPECIFIC TIME REQUIREMENTS FOR REVIEW; CLEAN UP COMMISSION REVIEW LANGUAGE; CHANGE IN CURRENT FEE STRUCTURE; CHANGING LANGUAGE THAT REFERS TO SIGNAGE ALONG HIGHWAYS, AND ALLOWS NONCOMMERCIAL ADVERTISING FOR OFF-SITE ADVERTISING WHEREAS, at the special meeting of the Mohave County Planning and Zoning Con~ission held on November 28, 1990 a public hearing was held as a required step in the procedure for a Co~nission recommendation on amendments to the Mohave County Zoning Regulations and Mohave County Subdivision Regulations to the Board of Supervisors, and WHEREAS, a hearing was held to consider an amendment to the Mohave County Subdivision Regulations, modify to read as follows: IN ACCORDANCE WITH ARTICLE 1.9 OF THE MOHAVE COUNTY SUBDIVISION REGULATIONS THE BOARD OF SUPERVISORS WILL CONSIDER THE FOLLOWING AMENDMENTS TO THE MOHAVE COUNTY SUBDIVISION REGULATIONS: NOTATION: Deleted Text is shown as: [within fifteen (15)] New Text is shown as: Boldfaced and underlined. In the event of a recommendation of denial the motion shall be in writing and shall contain the findlngs of the Commission supporting the denial of the application. 3.8-5 A copy of the report or (resolution] motion setting out the action of the Commission shall be transmitted to the Board, to the subdivider and/or owner, and to such departments or agencies as may be deemed advisable by the Commission. 3.8-6 [A copy of the Commission's report shall be filed with the Clerk of the Board.] The Director of Plan~!.!!9 shall prepare a Resolution for the Board which outlines the recommendation ( s) and where appropriate the written findin s of the Commission for Board cons ideration and or action. In addition, all finalized and signed plats and accompanying data, agreements, sureties or guarantees, and other papers of documents necessary to the acceptance of this plat shall be deposited with the planning Director at least ten (10) working days prior to the regular cutoff date for the Board agenda submittal for the Board meeting at whic~he applicant desires to be heard. 3.14 Action by the Board. 3.14-3 All streets and parcels offered for dedication for public use by the plat may be accepted by the Board under conditiops delineated in the Planning and Zoning Commission [Resolution] recommendation as outlined in the Board Resolution and on the plat upon approval of the final plat. 3.15 Recording of Final Plat [Within ten (10) days of] After approval by the Board, the Clerk of the Board shall present, after all conditions as ~~t by the Board Resolution are met, said final plat(s) to the County Recorder and thereafter, record same with the County Recorder one of which will be returned to the engineer or surveyor if a conformed copy was presented in advance. No subdivision plat shall be recorded unless approved by the Board. 3.16 Other Land Divisions. 3.16-2 A parcel plat conforming ...... A copy of the ..... recommendation. THE FOLLOWING CHANGES ARE MADE TO THE MOHAVE COUNTY ZONING REGULATIONS IN ACCORDANCE WITH SECTION 40.1 OF THE MOHAVE COUNTY ZONING REGULATIONS. -SECTION 31 SIGN ORDINANCE - DEFINITIONS - (continued) NONCO~RCIAL MESSAGES - Any noncommercial messages, for visual co~unication that is used for the pu~pose of bringl~ the subject thereof to the attention of the public; but not incl_!l_~in9: a~y flag, badge or insignia of any government or governmen~~l agen~_or any civic, charitable, religious, patriotic, fraternal ~E similar org~niz_~tion, and further, not including any lawful display of merchandise. SECTION 31 SIGN ORDINANCE - (continued) Section 8, D. Off-Premise Signs: It is the policy of the Board of Supervisors and planning and zoning commission of Mohave County to permit off-premise signs to be located in viable commercial areas and to discourage the rezoning of lots and parcels for the sole purpose of installing off-premise signs. It i~~~~~ u~derstood that signs displaying noncommercial messages as defined herein shall not require placement in commercial areas ~s the intent of their installation shall be for the purpose of increased opportunities for public communication. ...... Designated" Sign Free" areas where gradual and eventual elimination rather than expansion of nonconforming off- premise signs and structures will be undertaken and no new signs will be installed as follows: [Highway 68 (through Golden Valley)] Designated areas on Highway 68 (through Golden Vall~ and designated areas on Highway 95 approaching Lake Havasu City and along Interstate 40 in the Yucca Area. Resolution 90-377 Page 8 WHEREAS, the increases as noted are in keeping with the cost associated with the operation of local government, and shall not generate any surplus fees for the services performed, and WHEREAS, the notice for public hearing for the Mohave County Planning and Zoning Commission was published in the Kingman Daily Miner, a newspaper of general circulation in the County Seat, the Mohave Valley News, TODAY News, Daily Spectrum, and Desert Echo on October 26, 1990 and was posted on October 29, 1989, as required by A.R.S. and the Mohave County Zoning Regulations, and WHEREAS, the Mohave County Planning and Zoning Commission, after review of the proposed changes did resolve at their public hearing on November 28, 1989 to unanimously recommend approval of this proposal and further recommended the Board approve the same, and WHEREAS, the above recommendation came after lengthy discussions with the development community, and their consultants in the public hearing and were agreed to with the understanding that the increased fee's would provide for additional staff to assist the Planning Commission Staff in the accomplishment of services, and P0~ ~. Resolution 90-377 Page 9 WHEREAS, the notice for public hearing for the Mohave County Board of Supervisors' meeting was published in the Kingman Daily Miner, a newspaper of general circulation in the County Seat, the Mohave Valley News, TODAY News, Daily Spectrum, and Desert Echo on November 29, 1990 and posted November 29, 1990, as required by A.R.S. and the Mohave County Zoning Regulations, and WHEREAS, the Mohave County Board of Supervisors, after public hearing, did resolve to approve the amendments to the Mohave County Subdivision Regulations and the Mohave County zoning Regulations as presented by the Mohave County Planning and Zoning Commission, at their special meeting of December 17, 1990, and NOW THEREFORE BE IT RESOLVED, by the Mohave County Board of Supervisors that the amendments as outlined in this Resolution are hereby approved, and they shall be in effect as of the approval date.
