PAGE 1 Of - OS RECORDING fEE 0.00 He RESOLUTION NO. 90-371 A RESOLUTION SETTING FORTH DENIAL OF A ZONING ESTABLISH A MOBILE HOME AS A RESIDENCE IN A COMMERCIAL) ZONE, LOCATED IN THE KINGMAN AREA, ARIZONA USE PERMIT TO C-2 (GENERAL MOHA VE COUNTY, WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held December 3, 1990 a public hearing was conducted to determine whether approval/denial should be granted to Charles Davis of Kingman, Arizona for a Zoning Use Permit to G~ establish a mobile home as a residence in a C-2 (General ~7f~ Commerc ial) zone, located in the New Kingman Addition Unit 8, -'..~"....." Tract 1101, Block 112, Lot 23, approximately 200 feet east of Bank Street on the north side of Northfield Avenue, located in the Kingman area, and WHEREAS, the subject property can be accessed from Northern Avenue via North Bank Street, north approximately 500 feet to Northfield Avenue thence east approximately 100 feet on the north side of the street. Review of floodplain map #040058-2165C indicates these lots to be clear of flooding potential. This lot is currently vacant and surrounding land uses consist of mostly fC:~ vacant land with some conunercial uses between this property and '~t~ the residential properties to the east on Northfield Avenue. In ~-,,:~~ addition this lot is immediately north of the Margaritaville '" Resolution No. 9~71 . Page 2 Restaurant property. The applicant has indicated that he has a buyer for the property who is aware that in the future he may be surrounded by commercial uses. The applicant has placed a trailer on the property and is waiting the outcome of this request before continuing with remodeling or removing the trailer, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on November 14, 1990 did generate a recommendation of DENIAL of the Zoning Use Permit based on the following: ~ "'::~.. /..:-<.... :....:.r..", '\;;"~::,;' 1. There are currently viable commercial uses between existing residences on Northfield Avenue and this lot. 2. There are other commercial uses in close proximity to this lot. 3. North Bank Street is a major, highly travelled street and the potential for continued growth in this particular area is high. 4. Current zoning is C-2 which allows an intensity of commercial uses which is not compatible to mixing residential and commercial uses as opposed to a C-1 zoning classification. 5. Although the applicant has indicated he or a subsequent owner of the property is willing to live with potential commercial uses Staff does not feel that allowing for this potential land use conflict would be in keeping with good planning practice. ~~:,::;~ .:::<':1 ~.::',..'~" ..,;..e_,',.:' ~'~ : ";;': ~;j~c;:) WHEREAS, upon revision of the County plan the land use pattern of this area may change but at this time the Commission recommends that this lot be vacated and reserved for commercial PAGE 2 OF 3 BK 1827 P6 7~ (FEE~90- 8228~) " . . Upon approval of the Board of Supervisors of this recommendation the applicant is advised to remove the existing mobile home from this site in an expeditious manner, and WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on November 18, 1990, and posted November 16, 1990 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 3, 1990 DENIED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, as outlined herein.
