PAGE 1 OF OS RECORDING fEE 0,;00 He RESOLUTION NO. 90-370 A RESOLUTION SETTING FORTH THE REZONING OF THE W~ NE~ SE~ SECTION 23, TOWNSHIP 23 NORTH, RANGE 17 WEST, FROM: A-R/36A (AGRICULTURAL RESIDENTIAL/THIRTY SIX ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: (SD)C-RE/9A (SPECIAL DEVELOPMENT COMMERCIAL RECREATION/NINE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE KINGMAN AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 3, 1990, a public hearing was conducted to determine whether approval should be granted to Leroy and Janice Leidenberger of Kingman, Arizona for a rezoning ....."" ;~:~@1 ,- ;,..:i\ >..~ '~~1V from existing A-R/36A (Agricultural Residential/Thirty-six Acre Minimum Lot Size) to (SD)C-RE/9A (Special Development Commercial Recreation/Nine Acre Minimum Lot Size) zone, approximately eight (8) miles north of Kingman on Stockton Hill Road in the Redwing Canyon area, and WHEREAS, Redwing Canyon is located approximately eight miles north of the City of Kingman on the west side of Stockton Hill Road. . Access to the property from Stockton Hill Road is via Redwing Canyon Road west approximately 1 1/4 miles on the south side of the road to an unnamed access road. The portion of this 20 acre parcel which the applicant wishes to rezone is the southern 10 acres. The applicant wishes to establish Equestrian activities with some off site horse riding to local scenes of interest. Review of floodplain map #040058-2155B indicates this area to be clear of flooding potential. The property is currently vacant with surrounding uses consisting of mostly . ~AGE 2 OF 4 BK1827 PG 70 (fEE~90- 82283) vacant land and some residential uses, and WHEREAS, staff has received a letter of complaing in regards to this proposal. Staff has evaluated this objection and complaintant does not meet twenty (20%) percent requirement in area or number for properties within the 300 foot radius of this proposal, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on November 14, 1990 did generate a recommendation of approval of the zone change request with the following conditions noted: ~^:~~~~ ''''~' .',..,...... -',' , ~~,. 1. That the portion of this parcel the applicant has designated to be C-RE be zoned (S-D)C-RE/9A. 2. The applicant comply with all applicable provisions of Sections 19-A, 25, 26, 27, and 31 of the Mohave County Zoning Regulations. 3. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 4. Each parcel shall have legal access. In addition proper legal access to this parcel from Stockton Hill Road shall be indicated on the Parcel Plat. 5. The establishment of minimum lot areas based on the size of the parcels per the recorded Parcel Plat. 6. The Parcel Plat shall show any surface drainage ways or FEMA zones. 7. Each parcel shall have legal access. 8. That the ZONING PLAN be approved for a (SD)C-RE/9A (Special Development/Commercial Recreation/Four Acre Minimum Lot Size) in accordance with Section 19 of the Mohave County Zoning Regulations. 9. The owner accepts that whenever a "SD" zone is granted, each phase of stage of development of building proposals shall be submitted to the planning staff, to be evaluated and compnred with the app)~oved 7.nning plan "" .AGE 3 OF 4 . Any significant change (as determined by the Planning Director - appealable to the Planning Commission) in the approved zoning plan shall require a rehearing on the change before the Commission, with a final determination to be made by the Board. 11. Staff will maintain the most current approved ZONING PLAN on file in the master zoning folder for reviews. 12. The use of this property may not be changed by the owner/developer or subsequent owners as it is approved unless subsequently approved by the Board in accordance with Arizona Statutes Annotated, Title II, Chapter 6, Section 11-832. 13. That a twenty-five (25') foot setback/buffer be established and maintained along the entire boundary where commercial uses and zoning abut single family residential zones, including A-R (Agricultural Residential) . Arizona Department of Environmental Quality approves the quantity and quality of the water supply. 16. Arizona Department of Environmental Quality approves the use and design of the sewage treatment facility for this development. 17. The development shall have adequate parking facilities. 18. That the above mentioned access roads shall be constructed to Standard Specification #101.10C. 19. Building/zoning permit(s) shall be obtained. The applicant should be aware this is a commercial facility and is subject to pertinent Building Code guidelines. 20. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, Being January 4, 1991, as per ARS 11-829E. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a pubLic hearing to grant an extension, determine compliance with t he schedule for development or cause . ... . . the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on November 18, 1990, and posted November 16, 1990 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 3, 1990 approved this change in zoning as recommended by the Mohave County ;~~ Planning and Zoning Commission and outlined herein. !:i~,~ "...j ::'~:].j MORAVE COUNTY BOARD OF SUPERVISORS /~ ,~/L#~ Lois J.
