RESOLUTION NO. 90-369
A RESOLUTION SETTING FORTH THE REZONING OF LOT 5, BLOCK J, GOLDEN
SAGE RANCHOS UNIT 56, FROM: A-R/IA (AGRICULTURAL RESIDENTIAL/ONE
ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: C-2H (HIGHWAY
COMMERCIAL) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MORAVE
COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on December 3, 1990, a public hearing was
conducted to determine whether approval should be granted to
Glenn Kirkeby of the Village of Oak Creek, Arizona for a rezoning
from existing A-R/1A (Agricultural Residential/One Acre Minimum
Lot Size) to C-2H (Highway Commercial) zone, occupying the
southwest corner of Kayenta Road and Highway 68, located in the
Golden Valley area, and
WHEREAS, the subject property has frontage on the south side
of Highway 68 approximately one mile west of the Highway 68 and
93 junction.
Review of floodplain map #040058-2325B indicates
this area to be clear of potential flooding.
The land is
currently vacant and surrounding land uses consist of vacant land
south of Highway 68 and a mixture of residential and vacant land
north of the highway.
There is a conditionally C-2H zoned
property to the west of this parcel but the conditions have not
been met at this time, and

WHEREAS, the applicant originally approached staff in late
Mayas to the feasibility of rezoning this property.
Staff
advised the applicant to contact the surrounding property owners
to see what, if any, objections might be raised.
The applicant
did so and obtained signatures from the surrounding property
owners. In the interim the policy regarding area plan amendments
was enacted.
Thus the applicant is now at this stage of
processing his rezone request.
This one+ (1.08) acre parcel is
just over the required acreage for C-2H property that is not
served by a community water system, and

WHEREAS, a public hearing before the Mohave County Planning
and zoning Commission on November 14, 1990 did generate a
recommendation of approval of the zone change request with the
following conditions noted:
1. The applicant comply with all applicable provisions of
Sections 25, 26, 27, & 31 of the Mohave County zoning
Regulations.
2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.

That the Board of Supervisors accept the dedication of
a twenty (20') foot right-of-way along the south
boundary of this parcel for a future frontage road (see
Exhibit "A"). In conjunction with a twenty (20') foot
radius at the Kayenta Road intersections with Highway
6 8 and the frontage road. Along with an eight (8 I )
foot PUE on the above mentioned roads as they are
contiguous to this property. This shall be approved
through the recording of the resolution authorizing
this zone change and that the dedication statement and
dedication be shown on the Parcel Plat. NOTE: Standards
usually allow for frontage roads along the highway

however, ADOT in a written memo has indicated their
desire to not have a frontage road in close proximity
to the highway right-of-way.
4. The Parcel Plat shall show any surface drainage.
5. The development shall have adequate parking facilities.
6. Arizona Department of Water Resources approves the
water supply and distribution system.
7. Arizona Department of Environmental Quality approves
the quantity and quality of the water supply.
8. Arizona Department of Environmental Quality approves
the use and design of the sewage treatment facility for
this development.

9. All paving (driveways and parking) be paved in
accordance with Mohave County Standard Specification
#171 or better, and that such paving be completed
within ninety (90) days of the certification of
occupancy granted the building.
10. Building/Zoning permit(s) shall be obtained.
11. A one (1') foot vehicle non-access easement and
physical barrier a minimum of three (3') feet in height
will need to be provided on the perimeter of the
development frontage adjacent to Highway 68 right-of-
way.
12. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being
January 4, 1991, as per ARS 11-829E.
13. If these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.

WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona on November 18, 1990, and posted November
16, 1990 as required by Arizona Revised Statutes, and the Mohave
County Zoning Regulations, and
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, December 3, 1990 approved
this change in zoning as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
