A RESOLUTION SETTING FORTH THE REZONING OF A PORTION OF S~ SE~
SE~ SECTION 34, TOWNSHIP 21 NORTH, RANGE 19 WEST, FROM: A-R/36A
(AGRICULTURAL RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE,
PROPOSED TO BE: A-R/1A (AGRICULTURAL RESIDENTIAL/ONE ACRE MINIMUM
LOT SIZE) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MORAVE COUNTY,
ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on December 3, 1990, a public hearing was
conducted to determine whether approval should be granted to John

Caponetto of Kingman, Arizona for a rezoning from existing A-
R/36A (Agricultural Residential/Thirty Six Acre Minimum Lot Size)
to A-R/IA (Agricultural Residential/One Acre Minimum Lot Size)
zone, occupying the northwest corner of Shinarump Drive and
Estrella Road, located in the Golden Valley area, and
WHEREAS, Section 34 is approximately 9 miles west of the
Highway 68 and 93 junction and approximately 4 1/2 miles south of
Highway 68. The subject property is accessed from Highway 68 via
Estrella Road south approximately 4 1/2 miles on the west side of
the road and occupies the northwest corner of Shinarump Drive and
Estrella Road. Review of floodplain map #040058-2325B indicates
the presence of a wash having flooding potential in close
proximity to this property. This parcel is currently occupied by
a mobile home and surrounding uses consist of mostly vacant land

with some residences, and

WHEREAS, the applicant desires to split this 3+ acre parcel
into three 1+ acre parcels.
The current AR/36A zoning occurred
as a result 0 f the zoning over lay in 1987.
This parcel lies
within the Golden Valley Improvement District, and
WHEREAS, a public hearing before the Mohave County Planning
and Zoning Commission on November 14, 1990 did generate a
recommendation of approval of the zone change request with the
following conditions noted:

1.
Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
2. The establishment of a mlnlmum lot size based on the
size of parcels per the recorded Parcel Plat.
3. Each parcel shall have legal access.
4. Each parcel shall meet or exceed one (1) acre exclusive
of road easements.
5. The Parcel Plat shall show any surface drainage or FEMA
flood zones.
6. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being
January 4, 1991, as per ARS 11-829E.

I f these conditions are not met wi thin one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause

the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona on November 18, 1990, and posted November
16, 1990 as required by Arizona Revised Statutes, and the Mohave
County Zoning Regulations, and
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, December 3, 1990 approved
