RESOLUTION NO. 90-366
A RESOLUTION SETTING FORTH THE REZONING OF A PORTION OF PARCEL
256, SECTION 11, TOWNSHIP 21 NORTH, RANGE 19 WEST, FROM: AR/10A
(AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE,
PROPOSED TO BE: AR/2A (AGRICULTURAL RESIDENTIAL/TWO ACRE MINIMUM
LOT SIZE) AND AR/10A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM
LOT SIZE) ZONES, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE
COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on December 3, 1990, a public hearing was
conducted to determine whether approval should be granted to

Donna (McLelland) Stone of Kingman, Arizona for a rezoning from
existing A-R/10A (Agricultural Residential/Ten Acre Minimum Lot
Size) to A-R/2A (Agricultural Residential/Two Acre Minimum Lot
Size) and A-R/ lOA (Agricultural Residential/Ten Acre Minimum Lot
Size) zones, between Cibola and Concho Roads south of Highway 68,
located in the Golden Valley area, and
WHEREAS, Section 11 is located approximately 9 miles west of
the Highway 68 and 93 junction and is bisected by Highway 68.
The subject property has frontage on the highway and is located
between Cibola and Concho Roads, Concho Road being a midsection
line road. Review of floodplain map #040058-2325B indicates the

boundaries of the flood zone shall be designated on a parcel plat
if this request is granted, and
WHEREAS, this parcel is currently designated for commercial
uses according to the Golden Valley Area Plan.
The applicant
desires to split this 19+ acre parcel into two 2.4+ and one 14.5+
acre parcels. The applicant has no plans for commercial uses at
this time but may place a commercial use on the larger parcel at
some time in the future, possibly when highway improvements are
completed, and

WHEREAS, a public hearing before ,the Mohave County Planning
and Zoning Commission on November 14, 1990 did generate a
recommendation of approval of the zone change request with the
following conditions noted:
1. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
2. The northern parcel shall remain zoned as A-R/10A.
3. The southern two (2) parcels shall be zoned A-R/2A.
4. The establishment of a minimum lot size based on the
size of parcels per the recorded Parcel Plat.
5. Each parcel shall have legal access.
6. The Parcel Plat shall show any surface drainage or FEMA
flood zones.
7. The two (2) southern parcels shall meet or exceed two
(2) acres exclusive of road easements.

8. The northern parcel meet or exceed ten ( 10) acres
exclusive of road easements.

9. That the easterly fifty (50 ') feet of the roadway
easement known as Cibola Road and the westerly fifty
(50') feet of the roadway easement known as Concho Road
be abandoned as they are contiguous to this property
and revert to acreage. These reversions are to be
replaced by thirty (30') and thirty-five (35') foot
right-of-way dedications respectively. The the Board
of Supervisors accept the dedication of a thirty (30')
foot right-of-way along Cibola Road and a thirty-five
( 35 ') foot right-of-way along Concho Road as they are
contiguous to this property. In conjunction with a
twenty (20') foot radius at the intersections of the
above mentioned roads and Highway 68. Along with an
eight (8') foot public utility easement on the above
mentioned roads as they are contiguous to this
property. This shall be approved through the recording
of the resolution authorizing this zone change and that
the dedication statement and dedication be shown on the
Parcel Plat.
10. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being
January 4, 1991, as per ARS 11-829E.
11. I f these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, December 3, 1990 approved
this change in zoning as recommended by the Mohave County
Planning and zoning Commission and outlined herein.
