RESOLUTION NO. 90-365 A RESOLUTION SETTING FORTH THE REZONING OF LOT 1, BLOCK J, GOLDEN VALLEY RANCHOS UNIT #12, FROM: AR/2A (AGRICULTURAL RESIDENTIAL TWO ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: AR/1A (AGRICULTURAL RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 3, 1990, a public hearing was conducted to determine whether approval should be granted to Ruby Virginia Clevenger Dons of Nice, California for a rezoning from :,-'~ ;i~ ~....:\;J;~ existing A-R/2A (Agricultural Residential/Two Acre Minimum Lot Size) to A-R/1A (Agricultural Residential/One Acre Minimum Lot Size) zone, occupying the southeast corner of Tapeats Drive and Dilkon Road, located in the Golden Valley area, and WHEREAS, Golden Valley Ranches Unit 12 is approximately ten (10) miles west of the Highway 68/93 junction and approximately four (4) miles south of Highway 68. This unit is slightly east of the Black Mountain Foothills. The subject property is accessed from Highway 68 via Egar Road south to Tapeats Drive (.5 mile north of Shinarump Drive) , thence west to the southwest intersection of Tapeats and Dilkon Road which this property occupies, and - - " Resolution No. 941t65 . Page 2 PAGE 2 OF J BK 1827 PG 53 (FEE~90- 82278) WHEREAS, review of floodplain map #040058-2300B indicates this area to be clear of potential flooding. The south half of this unit is fairly well developed, while the north half is vacant. The applicant wishes to split this two plus (2+) acre parcel into two (2) one plus (1+) acre parcels, both having frontage of Tapeats Drive. A rezone request for Lot 16, immediately to the west of this lot, was approved by the Commission in September of this year. This unit lies within the Golden Valley Improvement District, and WHEREAS, a public hearing before the Mohave County Planning ~ ~','~?r;~ ~~~ t~~~~ and Zoning Commission on November 14, 1990 did generate a recommendation of approval of the zone change request with the following conditions noted: 1. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 2. The establishment of a mlnlmum lot size based on the size of parcels per the recorded Parcel Plat. 3. Each parcel shall have legal access. 4. Each parcel shall meet or exceed one (1) acre exclusive of road easements. 5. The Parcel plat shall show any surface drainage or FEMA flood zones. 6 . That the Board of Supervisors accept the dedication of a twenty (20') foot radius at the intersections of Tapeats Drive and Dilkon Road. This shall be approved through the recording of the resolution authorizing this zone change and that the dedication statement and dedication be shown on the Parcel Plat. ,+-~ ;~~ (:;-~ i2~iI . ., Resolution ~ 90-365 . The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being January 4, 1991, as per ARS 11-829E. 8. I f these conditions are not met wi thin one (1) year this approval shall be void. I f at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on November 18, 1990, and posted November 16, 1990 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 3, 1990 approved this change in zoning as recommended by. the Mohave County Planning and Zoning Commission and outlined herein.
