PAGE 1 OF : BOS RECORDING FEE 0.00 He RESOLUTION NO. 90-360 A RESOLUTION SETTING FORTH DENIAL OF A REQUEST TO ABANDON A PORTION OF SECTION 13, TOWNSHIP 9 NORTH, RANGE 22 EAST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held December 3, 1990 a public hearing was conducted to determine whether denial/approval should be granted to the Bureau of Indian Affairs, Colorado River Agency, Parker, Arizona, for an abandonment a portion of Section 13, Township 9 North, Range 22 East, f~ t:)f~ '-1"-~."~ also known as tax parcels 216-06-064 and 068, approximately one-half (.5) mile north of Courtwright Road on the west side of Evans Lane, located in the South Mohave Valley area, and WHEREAS, this abandonment is a mandate directed toward Mohave County by the Bureau of Indian Affairs (BIA). The BIA office in Parker, Arizona has taken the position that Mohave County is trespassing on a portion of Section 4, Township 17 North, Range 22 West. Furthermore, the BIA, on behalf of the Fort Mojave Indian Tribe, has directed Mohave County to vacate the roadway parcels after concluding that we have no authority to claim ownership, and WHEREAS, Mohave County accepted these parcels in 1984 via Resolution 1888 from private citizens. These citizens established the .,;. ..... roadway parcels on~y 22, 1977 in order to ~ide several parcels of land in Section 13, Township' 2. public access to North, Range 22 East, and ~AGE 2 OF 2 BK 1827 PG 37 (FEEt90- 82273) WHEREAS, because there is continuing litigation of the accretion lands in this particular area, it is not recommeded that either the Commission or the Board make a ruling on this item for reasons of unknowingly providing substantiation of either side's apparent claim to said property, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on November 14, 1990 did generate a recommendation of DENIAL based on the following: 1. As per A. R. S. 28-1908, the County cannot vacate access to private lands. f~1 ,':'-';":".,;,.,1 WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on November 18 and 25, 1990, and posted November 16, 1990 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 3, 1990 DENIED this abandonment request as recommended by the Mohave County Planning and Zoning Commission, as outlined herein, MOHAVE COUNTY BOARD OF SUPERVISORS LOisq::~ar.l i~~
