RECOROING'fEE 0.00 He RESOLUTION NO. 90-359 A RESOLUTION SETTING FORTH THE REZONING OF LOT 46, MORAVE MESA, TRACT 1021, SECTION 27, TOWNSHIP 19 NORTH, RANGE 22 WEST, FROM: C-2 (GENERAL COMMERCIAL) ZONE, PROPOSED TO BE: C-MO/1A (COMMERCIAL MANUFACTURING/OPEN LOT STORAGE/ONE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 3, 1990, a public hearing was conducted to determine whether approval should be granted to John :.,'~ ~~~~~ ~. :.....r~ :.:~%j "",,-; ,"."'::,jI E. Coleman, Dolores C. Coleman, and Ronald L. Garcia of Riviera, Arizona for a rezoning from existing C-2 (General Commercial) to C-MO/1A (Commercial Manufacturing/Open Lot Storage/One Acre Minimum Lot Size) zone, located in the South Mohave Valley area, and WHEREAS, Mohave Mesa, Tract 1021 is located approximately two miles south of Bullhead City and on the west side of Highway 95. Access to the subject property from Highway 95 is west via Hammer Road, a midsection line road, to Lakewood Road. Lot 46 occupying the northwest corner of Hammer Lane and Lakewood Road. Lot 46 is currently vacant and surrounding land uses consist of a mixture of residential and commercial uses. Page 2 PAGE ; 20F . . ~K~2? f'u 33 (fIT.~90- 82272~ WHEREAS, this lot lies within the C-M and C-MO designated area as identified by the South Mohave valley area plan, and WHEREAS, review of tract maps indicate this lot is greater than ten thousand (10,000) square feet and the standard C-MO zoning may not be appropriate. The Commission staff recommends APPROVAL of a zone change to C-MO/1A (Commercial Manufacturing/Open Lot Storage/One acre minimum lot size), and mIEREAS, a public hearing before the Mohave County Planning and Zoning Commission on November 14, 1990 did generate a recommendation of approval of the modified zone change request, being C-MO/1A (Commercial Manufacturing/Open Lot Storage/One Acre Minimum Lot Size), with the following conditions noted: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. 2. Any open lot storage must be related to or be an accessory to the primary business. 4 . 3. Such storage shall be completely enclosed by a view- obscuring fence which extends two (2') feet above the highest item to be stored, with a minimum of six (6') feet and a maximum of eight (S') feet in height. Such a fence shall display no advertising. The applicant shall pave the driveway access and parking in accordance with Mohave County Standard Specification #171, or better. The storage area shall be covered with a dust-proof surface. Page 3 PAGE" :3 OF 4 2r. 1817 PG 34 (FEE~90- 82272) 5. The applicant shall obtain a building permit. 6. Arizona Department of Water Resources approves the water supply and distribution system. 7. Arizona Department of Environmental Quality approves the use and design of the sewage treatment facility for this development. 8. Arizona Department of Environmental Quality approves the quantity and quality of the water supply. 9. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being January 4, 1991, as per ARS 11-829E. :~~~i "'<t~ /~_. ~~ ~:~~~ 10. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on November 18, 1990, and posted November 16, 1990 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 3, 1990 approved .
