PAGE lOf 3 BOS RECOROING FEE 0.00 He " RESOLUTION NO. 90-358 A RESOLUTION SETTING FORTH THE REZONING OF A PORTION OF THE W~ S~ S~ SE~ SW~ SECTION 25, TOWNSHIP 19 NORTH, RANGE 22 WEST, FROM: A- R (AGRICULTURAL RESIDENTIAL) ZONE, PROPOSED TO BE: R-O/30M (SINGLE FAMILY RESIDENTIAL/MOBILE HOMES PROHIBITED/THIRTY THOUSAND SQUARE FOOT MINIMUM LOT SIZE) ZONE, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 3, 1990, a public hearing was conducted to determine whether approval should be granted to ~~ Archy Bernard Kloek, Rancho Cucamonga, California for a rezoning ,'.';;; ~.~l::~J \. ,.:,~', from existing A-R (Agricultural Residential) zone to R-O/30M (Single Family Residential/Mobile Homes Prohibited/Thirty Thousand Square Foot Minimum Lot Size) zone, approximately 1.5 miles east of Highway 95 on the north side of Joy Lane, located in the South Mohave Valley area, and WHEREAS, the subject property is accessed from Highway 95 via Joy Lane approximately 1.5 miles east on the north side of the road. This parcel has frontage on Joy Lane. Review of floodplain map #040058-2445C indicates this area is in a minor flood zone. This property is currently vacant and surrounqing i;:-~ land uses consist of Tierra Del Rio to the west and proposed :;~ Allington Acres and Charisma subdivisions to the east with mostly ...:.] vacant land to the north. The applicant desires to split this ~esolution No. 904laS . Page 2 PAGE 2 OF J 8r. 1827 PG 30 (FEE~90- 82271) ., I. 47 acre parcel into two .7+ acre parcels. The applicant has apparently requested the R-E zone rather than the R-O zone because of the allowance for noncommercial guest homes. The Commission reviewed the application to determine whether the R-E should be granted or suggest the applicant modify his request and ask for R-O zoning to match the zoning of the Tierra Del Rio development to the east. The Commission, after deliberation, recommended the Board approve the rezone as R-O (Single Family Residential/Mobile Homes Prohibited), and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on November 14, 1990 did generate a recommendation of approval of the zone change request with the following conditions noted: 1. Submittal and recordation of a Parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 2. Each parcel shall meet or exceed thirty thousand (30,000) square feet. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The Parcel Plat shall show any surface drainage. 6. Building/zoning permit(s) shall be obtained. 7. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being January 4, 1991, as per ARS 11-S29E. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on November 18, 1990, and posted November 16, 1990 as required by Arizona Revised Statutes, and the Mohave ~~ County Zoning Regulations, and "~~ NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 3, 1990 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
