RESOLUTION NO. 90-354 A RESOLUTION SETTING FORTH THE REZONING OF A PORTION OF SECTION 31, TOWNSHIP 19 NORTH, RANGE 21 WEST, TO BE KNOWN AND SUBDIVIDED AS RANCH ON JOY LANE, TRACT 4113, FROM: RE/10A (RESIDENTIAL RECREATION/TEN ACRE MINIMUM LOT SIZE, PROPOSED TO BE: (SD)R/6M (SPECIAL DEVELOPMENT RESIDENTIAL/SIX THOUSAND SQUARE FOOT MINIMUM LOT SIZE), (SD)R/1A (SPECIAL DEVELOPMENT RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE), (SD)R/37A (SPECIAL DEVELOPMENT RESIDENTIAL THIRTY-SEVEN ACRE MINIMUM LOT SIZE), (SD)M/2A (SPECIAL DEVELOPMENT MANUFACTURING/TWO ACRE MINIMUM LOT SIZE), AND (SD)R- MH/48A (SPECIAL DEVELOPMENT RESIDENTIAL MOBILE HOMES/FORTY-EIGHT ACRE MINIMUM LOT SIZE) ZONES, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA ~~ @~..:;i 1:>:..,.' L...:.:~ WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 3, 1990, a public hearing was conducted to determine whether approval should be granted to Shapiro & Jones, Inc., Phoenix, Arizona for a rezoning from existing RE/10A (Residential Recreation/Ten Acre Minimum Lot Size) zone to (SD)R/6M (Special Development Residential/Six Thousand Square Foot Minimum Lot Size), (SD)R/1A (Special Development Residential/One Acre Minimum Lot Size), (SD)R/37A (Special Development Residential/Thirty-seven Acre Minimum Lot Size) , (SD)M/2A (Special Development Manufacturing/Two Acre Minimum Lot Size) , and (SD)R-MH/48A (Special Development Residential Mobile Homes/Forty-eight Acre Minimum Lot Size) zones, approximately two (2) miles east of Highway 95 on the south side of Joy Lane, located in the South Mohave Valley area, and . The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. 2. The use of this property may not be changed by the owner/developer or subsequent owners as it is approved unless subsequently approved by the Board in accordance with Arizona Statutes Annotated, Title II, Chapter 6, Section 11-832. 8. The preliminary plat indicates a lot designated as commercial. The area plan makes no allowance for commercial zoning in this section. Therefore, the lot designated as commercial on the preliminary plat (Block 1, Lot 1) shall be zoned (S-D)R/1A until an amendment Resoluttlk No. 90-354 . Upon it's approval by the Board, Block 1, Lot 1, shall become SD/C after the Resolution is recorded by the Clerk of the Board updating the Area Plan to allow Commercial at this location. 10. That the ZONING PLAN be approved for a (SD)R/6M (Special Development/Six Thousand Square Foot Minimum Lot Size) in accordance with Section 19 of the Mohave County Zoning Regulations. NOTE: The following apply to the S-D/R-MH development phase. 11. That the ZONING PLAN be approved for a (SD)R-MH/48A (Special Development/Single Family Residential Mobile Home/Forty-eight Acre Minimum Lot Size) in accordance wi th Section 19 of the Mohave County Zoning Regulations. <~'1l r':1.,.. ,~,.., .;j '.'.-'.'" ...'-~ :;~7~ 12. The S-D/R-MH development shall submit plans in conformance to Mohave County Regulations Section 27. I or its successor and said plans shall be approved prior to any development. 13. That lots within this parcel will not be for sale unless or until they have been approved as subdivided parcels by Mohave County Planning and Zoning and have met all requirements of the State of Arizona. NOTE: The following apply to the S-D/M development phase. 14. That the ZONING PLAN be approved for a (SD)M/2A (Special Development/General Manufacturing/Two Acre Minimum Lot Size) in accordance with Section 19 of the Mohave County Zoning Regulations. 15. That parcel L be zoned S-D/M/2A to facilitate a wastewater treatment plant and this zoning shall revert to SD/R upon hook up to an off-site sewer system. 16. The applicant comply with all applicable provisions of Section 23 of the Mohave County Zoning Regulations. Particularly in regards to appropriate screening. That the ZONING PLAN be approved for a (SD)R/37A (Special Development-Residential/Thirty-seven Acre Minimum Lot Size) zone in accordance with Section 19 of the Mohave County Zoning Regulations. (Blocks 29,30,31) 18. That the ZONING PLAN be approved for a (SD)R/1A (Special Development-Residential/One Acre Minimum Lot Size) zone in accordance with Section 19 of the Mohave County Zoning Regulations. (Block 1, Lot 1, see #9 above) 19. The density for the multifamily area be shown on the final plat. By definition the density for an R-M development cannot be higher than seven (7) units per acre. Any density higher than this must be zoned S- D/R. 20. Adequate parking shall be implemented in accordance with the Mohave County Zoning Ordinance. 25. The water system will provide adequate flows for fire protection. F ire hydrants conforming to the minimum County Standards shall be provided and located no more than seven hundred fifty (750') feet apart and/or such standards as acceptable and prescribed by the Fort Mohave Mesa Fire Department. The owner/developer shall, develop a drainage plan and cause the drainage related improvements to be completed as recommended by the project engineer and approved by the County Engineer (and other government agency(s) as required) as well as address drainage flowing through the site as well as those created on the site so as to not adversely affect downstream property owners. ,. The project design will allow for adequate PUE I s to extend underground electric and telephone services to each structure or facility site in accordance with Arizona Corporation Commission Regulations as well as other essential utility services such as water, sewer and fire flow. 28. All street centerline monuments will be staked and monumented in accordance with Mohave County Engineering Standard Specification No. 102. 29. As a condition of approval due to the magnitude of this project, the owner/developer is responsible for the completion of these site improvements to insure the proper health, safety,and welfare standards are completed and shall provide an assurance for all required development improvements as outlined in Article V of the Mohave County Subdivision Regulations or as approved by the Board. That the owner/developer shall obtain right-of-way for and pave Joy Lane and in addition pave other project roads indicated on the preliminary plat as they are contiguous to this property (Canyon Creek Boulevard, Canyon Creek Drive, Salinas Drive and Salinas Way). This may be accomplished in phases as approved by the Planning and Zoning Commission and Board. The paving of the aforementioned roads shall be placed on the center line of roadway right-of-ways in a width and design as approved by the County Engineer. 31. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 32. Establishment of minimum lot area based on the size of the parcel per the recorded Parcel Plat. 33. All FEMA Flood Zone(s) location(s) as well as any other minor washes that may be present in the final site design form shall be indicated on the Parcel Plat. ,:..".....;.,~ .. ., ~. . , ;';~ : ";1 ~-:J 34. All streets within the development will be constructed and paved with asphaltic concrete on accordance with Mohave County Engineering Standard Specification #171 or better, the streets will include curb and gutter on the interior streets. Street name and regulatory signs will be installed in accordance with the recommendation of the design engineer and approval of the Mohave ,County Engineer. 36. A one (1') foot vehicle non-access easement and physical barrier a minimum of three (3') feet in height will need to be provided on the perimeter of the development fronting Joy Lane, Canyon Creek Boulevard, Canyon Creek Drive, Salinas Drive and Salinas Way. i~ l~~J f~~ ,"'.:J 37. Traffic enhancement costs as required by Mohave County Road Department at the intersection of project roads and Joy Lane, both in design and construction and signage, will be the responsibility of the owner/ developer and are a condition of approval for this development. This will also apply to off premises traffic signage as required by the County Engineer for the approaches to and from the development. These are one time costs only. 38. The county has previously amended and approved up to 16 dwelling units (d.u.) per acre for R-M (Multiple- Residential) projects with amenities. Staff is of the opinion the applicants request for higher density should be approved if the applicant can match the high standards set forth by the previous, precedent setting cases such as: - locked RV parking - laundry facilities - recreational facilities other than pools - pool with proper fencing and limited access The lack of amenity provisions should revert the requested d.u. density to the 7 d.u. per acre density as set by ordinance. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on November 18, 1990, and posted November . '. Page 7 16, 1990 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 3, 1990 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
