PAGt 1 OF 4 r.OHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE O.uONC RESOLUTION NO. ,91-17 A RESOLUTION SETTING FORTH THE REZONING OF THE El:z NE!.., SECTIO.N 27, TOWNSHIP 16 NORTH, RANGE 13 WEST, FROM: A (GENERAL) ZONE, PROPOSED TO BE, SD/C-RE/75A (SPE;CTAL DEVELOPMENT COMMERCIAL RECREATION/SEVENTY-FIVE ACRE MINIMUM~OT SIZE) ZONE, LOCATED EAST OF WIKIEUP, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on, December 3, 1990, a public hearing was conducted to determine whether approval should be granted to Forrest & Janice purdy of Wikieup, Arizona for a rezoning from existing SD/C-RE/75A (Special (General) A zone to Development/Commercial Recreation/Seventy~Five Acre Minimum Lot Size) zone, located, just east of Wikieup, and WHEREAS, the subject property is located just south of Chicken Springs Road and according to assessors maps may be accessed via an unnamed county road approximately 1/4 mile south of, ,Chicken Springs Road. Review of floodplain map #040Q58-2913B indicates part of this 80 acre parcel may be affected by flooding from the Big Sandy Wil-sh. The applicant desires to establish a golf course on this parcel so the potential flooding could be mitigated., The land is currently vacant and surrounding uses ) consist of a residence about 1/4 mile away and the remainder being vacant land. The majority of uses in Wikieup are centered ------~_.-...._.....__,~~~~~~~.O"~~ ..--- ''':. . 4IIlAGE 2 OF 4 _~ 1842 PG 12 (FEE~91- 2026) Resolution No. 91-17 Page 2 along the highway which is approximately 1/2 to 3/4 of a mile from the west boundary of this parcel, and WHEREAS, a public hearing before the Mohave County Planning and zoning Commission on December 12, 1990 did generate a recommendation of approval of this zone change request contingent upon the following: 1. This parcel be zoned (S-D) C-RE/75A (Special Development/Commercial Recreation/Seventy-five Acre Minimum Lot Size). 2. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. 3. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 4. Proper legal access to this parcel from Highway 93 shall be indicated on the Parcel Plat. 5. The establishment of minimum lot areas based on the size of the parcels per the recorded Parcel Plat. 6. The Parcel Plat shall show any surface drainage ways or FEMA zones. 7 . That the ZONING PLAN be approved for a (SD) C-RE /7 5A (Special Development/Commercial Recreation/Seventy-five Acre Minimum Lot Size) in accordance with Section 19 of the Mohave County Zoning Regulations. 8. The owner accepts that whenever a "SD" zone is granted, each phase of stage of development of building proposals shall be submitted to the planning staff, to be evaluated and compared with the approved zoning plan before any permits may be granted. 9. Any significant change (as determined by the Planning Director - appealable to the Planning Commission) in the approved zoning plan shall require a rehearing on the change before the Commission, with a final determination to be made by the Board. .. The use of this property may not be changed by the owner/developer or subsequent owners as it is approved unless subsequently approved by the Board in accordance with Arizona Statutes Annotated, Title II, Chapter 6, Section 11-832. 12. Arizona Department of Water Resources approves the water supply and distribution system. 13. Arizona Department of Environmental Quality approves the quantity and quality of the water supply. 14. Arizona Department of Environmental Quality approves the use and design of the sewage treatment facility for this development. 15. The development shall have adequate parking facilities. 16. The primary access road to Highway 93, either Chicken Springs Road or the unnamed county road shall be paved in addition to any driveways and parking,. All paving shall be paved in accordance with Mohave County Standard Specification #171 or better, and that' such paving be completed wi thin ninety ( 90) days of the certification of occupancy granted the building and/or structures. 17. Building/Zoning permit(s) shall be obtained. 18. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, being February 7, 1991, as per ARS 11-849E. 19. If these conditions are not met within one (1) year this approval shall .be void. If at the expiration of this.period the property has not been improved for the use fOr which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. . (,",', ,. . .AGE 4 OF BK 1842 PG 4 14 (FEEt91- Page 4 2026) Resolution No. 91-17 WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on December 21, 1990, and posted December 20, 1990 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 7, 1991 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
