A RESOLUTION SETTING FORTH THE REZONING OF LOT 33, TIERRA VERDE, TRACT 1073-A, SECTION 14, TOWNSHIP 19 NORTH, RANGE 22 WEST, FROM: C-2 (GENERAL COMMERCIAL) ZONE, PROPOSED TO BE: C-2H (HIGHWAY COMMERCIAL) ZONE, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA RESOLUTION NO. 91-14 WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 3, 1990, a public hearing was conducted to determine whether approval should be granted to Elmer and Isabel Rittmiller of Burbank, California for a rezoning from existing C-2 (General Commercial) zone to C-2H (Highway Commercial) zone, located one lot south of Valencia Road on the east side of Highway 95, located in the South Mohave Valley area, and WHEREAS, Lot 33 has frontage on the east side of Highway 95 approximately 125 feet south of Valencia Road. Review of floodplain map #040058-2435C indicates this area is in a FEMA designated flood zone. This lot is currently used for cable storage. Surrounding uses consist of commercial uses to the north and south with residential uses to the east. There are a number of parcels along this frontage which have received C-2H zoning. The applicant wishes to have open lot storage capability in conjunction with his current business, and -"" ---.. ,.. . .AGE 2 OF BK 1842 PG 3 2 (FEE091- 2023) Resolution No. 91-14 Page 2 WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on December 12, 1990 did generate a recommendation of approval of this zone change request contingent upon the following: 1. The applicant comply with all applicable provlslons of Sections 25, 26, 27, & 31 of the Mohave County Zoning Regulations. 2. Arizona Department of Water Resources approves the water supply and distribution system. 3. Arizona Department of Environmental Quality approves the quantity and quality of the water supply. 4. Arizona Department of Environmental Quality approves the use and design of the sewage treatment fa,cility for this development. 5. All paving (driveways and parking) be paved in accordance with Mohave County Standard Specification #171 or better, and that such paving be completed within ninety (90) days of the certification of occupancy granted the building. 6. Building/Zoning permit(s) shall be obtained. 7. An ADOT access permit be obtained. 8. The development shall have adequate parking facilities. 9. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, being February 7, 1991, as per ARS 11-829E. 10. I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. ......" ~ ..... c . .PAGE 3 OF BK 1842 PG 3 3 (FEEt91- 2023) Resolution No. 91-14 Page 3 WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on December 21, 1990, and posted December 20, 1990 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 7, 1991 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
